NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF COLUMBIA Under and by virtue of the power of sale contained with that certain Deed to Secure Debt dated February 16, 2007, from RICKY LOPEZ to AMERICAN GENERAL FINANCIAL SERVICES, INC. (DE),recorded on February 20, 2007 in Deed Book 5855 at Page 252, Columbia County, Georgia Records, having been last sold, assigned, transferred and conveyed to U.S. Bank National Association as Indenture Trustee for Springleaf Mortgage Loan Trust 2013-2, Mortgage-Backed Notes, Series 2013-2 by Assignment and said Deed to Secure Debt having been given to secure a note dated February 16, 2007, in the amount of $79,670.70, said note being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Columbia County, Georgia, on December 6, 2016, the following described real property (hereinafter referred to as the "Property"):ALL THAT CERTAIN LOT OR PARCEL OF LAND LYING CONTAINING 0.7 ACRES, MORE OR LESS AND BEING DESIGNATED AS LOT NO. 38A OF THE RIDGE ROAD SUBDIVISION WITHIN THE CLARK HILL RESERVOIR AREA IN COLUMBIA COUNTY, STATE OF GEORGIA, AND BEING SHOWN ON PLAT RECORDED IN PC-AAA, SLIDE 41 NO. 3 OF THE PUBLIC RECORDS OF THE AFORESAID COUNTY AND STATE. THE PROPERTY HERBY CONVEYED IS SUBJECT TO THE RESTRICTION THAT NO STRUCTURE SHALL BE ERECTED THEREON WITHIN 25 FEET OF THE ROAD RIGHTS-OF-WAY OR 25 FEET OF COMMON LOT BOUNDARY.THIS CONVEYANCE IS MADE ON CONDITION THAT THE PROPERTY CONVEYED SHALL BE USED FOR COTTAGE SITE PURPOSE ONLY, AND IN THE EVENT OF USE FOE ANY OTHER PURPOSES, TITLE TO THE LAND AND IMPROVEMENTS SHALL REVERT TO AND VEST IN THE UNITED STATES OF AMERICA. AS USED THEREIN THE TERM "COTTAGE SITE" MEANS A PARCEL OF LAND DEVELOPED OR TO BE DEVELOPED BY THE CONSTRUCTION OF A PRIVATE COTTAGE THEREON AND USED, OR TO BE USED FOR PRIVATE RECREATIONAL PURPOSES. The debt secured by the Deed to Secure Debt and evidenced by the Note and has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Deed to Secure Debt, accrued interest, and all expenses of the sale, including attorneys' fees. Notice of intention to collect attorneys' fees has been given as provided by law. To the best of the undersigned's knowledge, the person(s) in possession of the property is/are RICKY LOPEZ. The property, being commonly known as 4052 Vern Sikking Rd, Appling, GA, 30802 in Columbia County, will be sold as the property of RICKY LOPEZ, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Deed to Secure Debt.
