STATE OF GEORGIA COUNTY OF RICHMOND Default having been made under the terms of a SECURITY DEED between TERRY D. CRESWELL to EDWARD L. OETJEN dated 4/6/2001, recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Book 726 at page 185; the said EDWARD L. OTEJEN has declared the balance due and payable and, in exercise of the powers contained in said SECURITY DEED will sell at public outcry to the highest bidder for cash on the first Tuesday in October, 2016, to-wit: October 4, 2016, between legal hours of sale before the courthouse door of RICHMOND COUNTY, GEORGIA, the following described property to-wit: ALL THAT LOT OR PARCEL OF LAND WITH IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN THE STATE OF GEORGIA, COUNTY OF RICHMOND, being known and designated as property located on the southside of the right of way of Tubman Road having a frontage of 84 feet and extending back on its eastern line 363.2 feet and on its western line 345.5 feet having a rear width of 80.4 feet, as is more fully shown on a plat thereof prepared by Billy B. Beazley, C. E., dated March 21, 1977, which is recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Reel 78 at page 1508; reference is made to said plat for a more complete and accurate description as to metes, bounds, and location of said property. Said property is subject to any restrictions and to easements of record to include Book 22 D at page 556 and Book 34 X page 71, and Leases recorded in Book 307 page 512, and Book 319, at page 487, said clerk's office. MAP AND PARCEL # 087 3 096 00 0 The debt secured under the terms and conditions of the SECURITY DEED has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed, and by law, including attorney's fees (notice of intent to collect attorney fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but are not yet due and payable), and matters which might be disclosed by an accurate survey and inspection of property and assessments, lien encumbrances, zoning ordinances, restrictive covenants, and matters of record superior to the SECURITY DEED first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is TERRY D. CRESWELL and the property is more commonly known as 2334 Mike Padgett Highway, Augusta, Georgia.
