NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY By virtue of a Power of Sale contained in that certain Security Deed from BIRKDALE, LLC to SECURITY FEDERAL BANK, dated December 28, 2006, recorded January 19, 2007, in Deed Book 01 1 00, Page 02060, Richmond County, Georgia Records, said Security Deed having been given to secure Notes dated December 28, 2006: (I) from Farmers & Truckers Biodiesel, LLC in the amount of $750,000.00; (2) from Farmers & Truckers Biodiesel, LLC dated December 28, 2006 in the amount of $270,000.00; and (3) from Birkdale, LLC dated December 28, 2006 in the amount of $395,977.00 (said Notes were modified by Modification Agreement dated October 9, 2009 between Aiken Biofuels, LLC f/k/a Farmers & Truckers Biodiesel, LLC, E&C Mobile Home Estates, LLC, Birkdale, LLC wherein the Notes were modified and a separate Note in the amount of $502,781.37 January 7, 2009 was given to Security Federal Bank and secured by the below described property), with interest thereon as provided for therein, there will be sold at public outcry to the highest bidder for cash at the Richmond County Courthouse, within the legal hours of sale on the first Tuesday in October, 2016, the following property described in said Security Deed: ALL those tracts or parcels of land, situate, lying and being in the State of Georgia, County of Richmond, being shown and designated as Parcel "C" containing 0.058 Acres, Parcel "D" containing 0.064 Acres and Parcel "E" containing 0.078 Acres as shown on a plat thereof prepared for Chuck R. Pardue by Joseph L. Holley, Jr., RLS dated May 3, 1999 and recorded in the Office of the Clerk of Court of the Superior Court of Richmond County, Georgia in Book 642, page 2019, reference being made to said plat for a more complete and accurate description as to the metes, bounds and location of said property. BEING the same property conveyed to Birkdale, LLC by deed of Chuck R. Pardue dated December 21, 2006 and recorded January 10, 2007 in Book 1099, page 474, Richmond County Records. Tax Map Numbers: Parcel C - 047-1-172-01 -O; Parcel D - 047-1-172-02-0; Parcel E - 047-1-172-03-0 ALSO a permanent easement over Parcels "A", "B" and "C" on said plat recorded in Realty Reel 642, page 2019, for ingress to and egress from Parcels "D" and "E" on said plat Said legal description being controlling, however, the property is more commonly known as 567 Greene Street and 308-310 Sixth Street, Augusta, Georgia, 30901. The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note. This indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys' fees (notice to collect same having been given) and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will also be subject to the following items which may affect the title: any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable); the right of redemption of any taxing authority; matters which would be disclosed by an accurate survey or by an inspection of the property; all zoning ordinances; assessments; liens; encumbrances; restrictions; covenants, and any other matters of record superior to said Security Deed.
