NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY By virtue of Power of Sale contained in the Deed to Secure Debt and Note from Deretha L. Henry ("Borrower") to Mary Jo McNeely ("Lender"), dated April 1, 2011 and filed for record April 5, 2011 and recorded in Book 01297, Page 1733 in the office of the clerk of the Superior Court of Richmond County, Georgia, the lender has called the note due and payable. Said Deed to Secure Debt being given to secure a Note of even date in the original principal amount of Sixty-Six Thousand and no/100 ($66,000.00) Dollars with interest from date at the rate as provided therein on the unpaid balance until paid there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Augusta, Richmond County, Georgia, within the legal hours of sale on November 1, 2016. The security being; All that lot, tract or parcel of land, with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond being known and designated as Lot 11, Block D of Pine Heights Western Subdivision as shown on a plat recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Book 21-E, page 125 to which plat reference is made for a more complete and accurate description as to the metes, bounds and location of said property. Map and Parcel No. 110-2-173-00-0 Said property is conveyed subject to Declaration of Covenants, and also subject to any and all easements, reservations and restrictions of record. The property is known under the present system of street numbering in Richmond County, Georgia as 1828 Cypress Street, Augusta, Georgia 30906. The debt secured by the Deed to Secure Debt and assignment has been and is hereby declared due because of, among other possible events of default, failure to comply with the terms of the Note, to include non-payment, as required by the Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys' fees.
