NOTICE OF SALE UNDER POWER

RABUN COUNTY
By virtue of the Power of Sale contained in a Deed to Secure Debt (Security Deed) from GAYNELLE STANCIL (Grantor) to TAMMY L. FAIR (Grantee), dated February 12, 1999, recorded in Deed Book O-18, page 406, Rabun County, Georgia records, said Security Deed being given to secure a Note dated in the original principal amount of twenty-three thousand five hundred dollars and 00/100 ($23,500.00), with interest from date at the rate as provided therein on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door in Rabun County, Georgia, within the legal hours of sale on the first Tuesday in October, 2016, to wit:
All that tract or parcel of land lying and being in Land Lot 6 of the Fifth Land District of Rabun County, Georgia and being more particularly described as follows, to wit:
The real property being hereby conveyed is a 15.76 acre tract of land that consists of a 32.05 acre tract of land described hereinbelow (Plat Book 32, Page 238), LESS AND EXCEPT a 7.042 acre tract of land (Plat Book 33, Page 281) and LESS AND EXCEPT a 9.253 acre tract of land (Plat Book 37, Page 319). For a full and complete description of said 32.05 acre tract of land, reference is hereby had and made to a plat of survey last revised August 28, 1992 and prepared by T. Lamar Edwards, Georgia Registered Land Surveyor No. 1837. Said plat is of record in Plat Book 32, page 238 in the Office of the Clerk of the Rabun Superior Court. Reference is had and made to said plats and the records thereof for a full and complete descriptions of the real property depicted thereon.
NOTE: Reference is hereby had and made to those certain Road and Utility Line Easements of record in Deed Book E-13, page 634 and Deed Book E-13, page 638, aforesaid records.
With all rights and appurtenances thereunto belonging.
The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, failure to comply with the terms of the Note. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of the sale, including attorneys fees.
The above described property will be sold subject to any outstanding Ad Valorem Taxes and/or assessments, if any and all other outstanding liens, restrictions, easement, and encumbrances. Said property will be sold, a deed executed by the undersigned, and the proceeds of sale applied to said debt, all in accordance with the power of sale set forth in a Deed to Secure Debt. Said property is being sold as the property of GAYNELLE STANCIL.
Notice has been given of the intention to enforce the provisions of foreclosure in said Deed to Secure Debt, in accordance with Georgia Law and the terms of said Deed to Secure Debt and Promissory Note.
