gpn14 HS Foreclosures NOTICE OF SALE UNDER POWER GEORGIA, LONG COUNTY Under authority of the powers of sale and conveyance contained in that certain Deed to Secure Debt given by CHARLIE COX, a/k/a CHARLIE COX, SR. to GLENNVILLE BANK, dated November 15, 2013, the same being recorded in Deed Book 425, Pages 363-369, Long County Records, conveying the after-described property to secure a Note dated November 15, 2013, executed by CHARLIE COX, a/k/a CHARLIE COX, SR., in the original principal amount of THIRTY ONE THOUSAND FIVE HUNDRED THIRTY AND 80/100 DOLLARS ($31,530.80), with interest thereon as set forth therein, there will be sold on the first Tuesday in November, 2016, within the legal hours of sale, before the Courthouse door in Ludowici, Long County, Georgia, at public outcry to the highest bidder for cash, the land conveyed in said security deed described as follows: TRACT ONE: All that certain lot, tract or parcel of land situate, lying and being in the 1672nd G.M. District of Long County, Georgia, and being identified as Lot Number 3 of Cox Estate, containing 1.00 acre, more or less, and bounded, now or formerly, as follows: North by other lands of Charlie Cox; East by lands of Tommy Cox; South by lands of Beatrice Cox Guyton; and West by lands of Charlie Cox. Said property is more accurately depicted by metes, bounds, courses and distances on a plat of survey prepared by John O. Parker, Georgia Registered Land Surveyor No. 1850 dated December 26, 1985, and recorded in the office of the Clerk of Superior Court of Long County, Georgia, in Plat Book 5, Page 67. Said plat is incorporated herein by reference for descriptive and all other purposes. Tract One is the same property as that described by Warranty Deed to Prentice Lee Cox from Prince Cox, et al., dated February 4, 1987, and recorded in the office of the Clerk of Superior Court of Long County, Georgia, in Deed Book 70, Page 295. TRACT TWO: All that certain lot, tract or parcel of land situate, lying and being in the 1672nd G.M. District of Long County, Georgia, and containing 1.00 acre, more or less, and bounded, now or formerly, as follows: North by lands of Charlie Cox and Ruby Dell Cox; East by other lands of Charlie Cox; South by lands of Beatrice Cox Guyton; and West by the 80' right of way of Kennedy Store Road. Tract Two is the same property as that described by Warranty Deed to Prentice Lee Cox from Lewis Cox dated March 8, 1962, and recorded in the office of the Clerk of Superior Court of Long County, Georgia, in Deed Book 29, Page 455. Tracts One and Two above are the same properties as those received by Charlie Cox from Prentice Lee Cox by Warranty Deed dated April 20, 1994, and recorded in the office of the Clerk of Superior Court of Long County, Georgia, in Deed Book 93, Page 723. TRACT THREE: All that certain lot, tract or parcel of land situate, lying and being in the 1672nd G. M. District of Long County, Georgia, containing 2.80 acres, more or less, and being designated as Lot Number 2 on a plat of the division of lands of the Pearl Cox Estate prepared by John O. Parker, Georgia Registered Land Surveyor No. 1850, dated December 26, 1985, and recorded in the office of the Clerk of Superior Court of Long County, Georgia, in Plat Book 5, Page 67. Said plat is incorporated herein by reference for descriptive and all other purposes. ALSO conveyed hereby is a 20' wide easement beginning at a paved road locally known as Time Saver Road and running along the northern boundary between other lands of Charlie Cox, Sr., upon which his home is situated and lands of Junious A and Ollie Mae Porter to the northwestern corner of the lands described above for purposes of ingress and egress. Said property is the same as that received by Charlie Cox by Deed of Division from Prince Cox et al., dated January 2, 1987, and recorded in the office of the Clerk of Superior Court of Long County, Georgia, in Deed Book 70, Page 319. The indebtedness secured by said Deed to Secure Debt has become in default as to principal and interest because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed and the whole amount of said indebtedness is declared to be in default and immediately due and payable, and the above-described property will be sold for the purpose of enforcing payment of the indebtedness secured by said Deed to Secure Debt. A deed will be executed to the purchaser at said sale conveying title as authorized in said Deed to Secure Debt. The proceeds of said sale will first be applied to the payment of the indebtedness to Glennville Bank, other charges and the expenses of sale as provided in said Deed to Secure Debt including attorney's fees (notice of intent to collect attorney's fees having been given) and the excess, if any, as provided by law. Said sale and the deed made to the purchaser at said sale will be subject to any outstanding unpaid ad valorem taxes on said property (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is Charlie Cox, a/k/a Charlie Cox, Sr., or the Estate of Charlie Cox, or a tenant or tenants.
