G9-49513 Dickinson NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF HARALSON Under and by virtue of the Power of Sale in a certain Deed to Secure Debt from Caroline Dickinson, Grantor, to Frances L. Hunt, Grantee, dated November 3, 2009, and recorded in Deed Book 996, Page 500 of the Public Land Records of Haralson County, Georgia, said Deed to Secure Debt having been given to secure a Promissory Note, dated November 3, 2009 and other indebtedness of borrower to the lender, there will be sold by the undersigned at public outcry, during the legal hours of sale before the door of the Courthouse of Haralson County, Georgia, on the first Tuesday in October, 2016, to-wit: October 4, 2016, to the highest and best bidder for cash, the following described property: Tract 1: All that tract or parcel of land lying and being in Land Lots No. 165 in the 7th district and 5th Section of Haralson County, Georgia, same being a part of the R. L. Hudson Heights Subdivision of said land lot according to plat thereof made by J. R. Baskin, Engineer, Rome, Georgia, and which plat appears of record in Plat Book 1, Page 58, in the Office of the Clerk of Superior Court of Haralson County, Georgia, and which plat is by leave or reference incorporated into and made a part of this description; said land herein conveyed is more particularly described as being the East 100 feet or Lots Nos. (, 10, and 11 in said Subdivision according to said plat, and said tract of land fronts on US Highway No. 27 for a distance of 75 feet and extends back West of uniform width a distance of 100 feet. Said property has situated thereon a 1984 Doublewide Spirit Mobile Home which has been installed on permanent foundations as part of the real estate. The above described property being the same property as that described in that certain Warranty Deed from Melyn Overton to Howard White and Celia C. White dated May 6, 1993, and recorded in Deed Book 333, page 145, Haralson County Deed Records. Tract 2: All that tract or parcel of land lying and being in Land Lot No. 165 in the 7th District and 5th Section of Haralson County, Georgia, and being a portion of Lot Nos. 9, 10, and 11 of the R.L. Hudson Heights Subdivision, and which is more particularly described as follows, to wit: To find the point of beginning, begin at the point where the Eastern right of way line of Garrett Avenue is intersected by the Southern right of way line of Hudson Drive, and from said point run along the Southern right of way line of Hudson Drive, North 67 degrees 16 minutes East 198.00 feet to the POINT OF BEGINNING; from said point of beginning, run along the Southern right of way line of Hudson Drive North 67 degrees 16 minutes East 17.00 feet; thence leaving the Southern right of way line of Hudson Drive run South 22 degrees 44 minutes East 75.00 feet; thence run South 67 degrees 16 minutes West 17.00 feet; thence run North 22 degrees 44 minutes West 75.00 feet to the point of beginning. The above description is made by reference to that certain plat prepared for Wyolene Williams by Paul E. Lee, Georgia Registered Land Surveyor No. 1715, dated July 27, 1977, a copy of which is recorded in Plat Book 6, Page 162, in the Office of the Clerk of Superior Court of Haralson County, Georgia, and which plat is by leave or reference incorporated into and made a part of this description. The above described property being a part or portion of the property described in that certain Warranty deed from Larry W. Blackmon to Wyolene Williams dated July 28, 1977, and recorded in Deed Book 195, Page 388, Haralson County Deed Records. In the year 2016, captioned property is known as 10 Hudson Drive, Bremen, GA 30110 and bears tax identification number BR080016. The debt secured by said Deed to Secure Debt and note has been and is hereby declared due and payable in full because of default pursuant to the terms of said Deed to Secure Debt and Note. Notice has been given of intention to enforce provisions for collection of attorney's fees and foreclosure in accordance with requirements of Official Code of Georgia Annotated Section 44-14-162.2 and the terms of the Deed to Secure Debt and Note. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Deed to Secure Debt, accrued interest and expenses of the sale and other sums secured by the Deed to Secure Debt including attorney's fees, and the remainder, if any shall be applied as provided by law. Frances L. Hunt at 770-833-4190 has the full authority to negotiate, amend, and modify all terms of the mortgage with the debtor. To the best of the undersigned's knowledge and belief the property is in the possession of Caroline Dickinson and said property will be sold as the property of Caroline Dickinson, subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above (including but not limited to that certain Deed to Secure Debt from Francis L. Hunt to Bank of North GA). The sale will be conducted subject to 1) confirmation that the sale is not prohibited under the U. S.
