NOTICE OF FORECLOSURE SALE UNDER POWER
GILMER COUNTY, GEORGIA
THIS IS AN ATTEMPT TO COLLECT A DEBT, ANY INFORMATON OBTAINED WILL BE
USED FOR THAT PURPOSE.
Under and by virtue of the Power of Sale contained in a Security Deed
given by ESMERELDA ZARAGOZA DIAZ and JOSE DIAZ to Ellijay
Insurance, Inc., dated September 9, 2014, and recorded in deed Book
1881, Page 199-203, Gilmer County Georgia Records, conveying the
after-described property to secure a Note in the original principal
amount of SEVENTY THOUSAND AND 00/100 DOLLARS ($70,000.00), with
interest thereon as set forth therein, there will be sold at public
outcry to the highest bidder for cash before the courthouse door of
Gilmer County, Georgia, within the legal hours of sale on October 4,
2016, the following described property:
Tax ID Number 3087 018
All that tract or parcel of land lying and being in Land Lot 248, 12th
District, 2nd Section of Gilmer County, Georgia,
consisting of 3.82 acres, as shown on plat of survey for Leslie O.
Bragg and Media L. Bragg. Said plat, dated August 11, 1996, by Joel
Jordan, Georgia Registered Land Surveyor No. 2430, is recorded in
Plat Book 27, page 139, Gilmer County Records, with reference made
thereto for the purpose of incorporating same. Included are all
improvements located thereon and permanently attached the following
Three (3) mobile homes:
1994 Redman double wide mobile home, serial number 11425717Aand B
1980 East single wide mobile home, serial number S66E143FB0174GA
1996 Sweetwater double wide mobile home, serial numbers SHGA1626A and B.
The debt secured by said Security Deed has been and is hereby declared
due because of, among possible events of default, failure to pay the
indebtedness as and when due and in the manner provided in the Note
and Security Deed. The debt remaining in default, this sale will be
made for the propose of paying the same and all expenses of this
sale, as provided in Security Deed and by law including attorney's
fees (notice of intent to collect attorney fee having been given).
The entity having full authority to negotiate, amend or modify all terms
of the loan (although not required by law to do so is Ellijay
Insurance, Inc., James R. Worley, Jr., President, they can be
contacted at (706)635-7645, or by writing to 763 South Main Street,
Suite 3, Ellijay, Georgia 30540, to discuss possible alternatives to
avoid foreclosure.
Said property will be sold subject to any outstanding ad valorem taxes
(including taxes which are a lien, but not yet due and payable), any
matters which might be discloed by an accurate survey and inspection
of the property, any assessments, liens, encumbrances, zoning
ordinances, restrictions, covenants, and matters of record superior
to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in
possession of the property is ESMERELDA ZARAGOZA DIAZ and JOSE DIAZ
or tenant(s), and said property is more commonly known as 1015
North Bull Gap Road, Talking Rock, Georgia 30175.
The sale will be conducted subject to (1) conformation that the sale is
not prohibited under the U.S. Bankruptcy Code (2) final confirmation
and audit of the status of the loan with the holder of the security
deed and (3) any right of redemption or other lien not extinguished
by foreclosure.
