CLASS:007 NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF COWETA By virtue of a power of sale contained in security deed given by CAREY MARBUT and RENEE MARBUT to CHRISTOPHER A. JACKSON and CATHY L. JACKSON, dated January 25, 2007, and recorded in Deed Book 3135, Page 839, Coweta County, Georgia records, conveying the after described property to secure a Promissory Note in the original principal amount of FIFTY-SIX THOUSAND AND 00/100 ($56,000.00) DOLLARS and any renewals, fees, extensions, or additional advances, with interest thereon as set forth therein plus all additional indebtedness and future indebtedness, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Coweta County, Georgia, within the legal hours of sale on the first Tuesday in October, the following described property: All that tract and parcel of land lying and being in Land Lot 258 of the 1st Land District, Coweta County, Georgia, containing 5.000 acres, more or less, and being more particularly described as follows: BEGINNING at the Southwest corner of Land Lot 258 of the 1st Land District and from said corner, thence run in a Northerly direction along the West line of Land Lot 258 N 00 degrees 30' l6" W 388.46 feet to a point; thence run N 89 degrees 00'00" E 560.67 feet to a point; thence run S 00 degrees 30' 16'' E 388.46 feet to a point located on the South line of Land Lot 258; thence run in a Westerly direction along the South line of Land Lot 258 S 89 degrees 00'00" W 560.67 feet to the Southwest corner of Land Lot 258 and the POINT OF BEGINNING. Being the same property identified as Tract 1B according to plat of survey for Flat Rock S/D as shown on plat of survey by John R. Christopher, R.L.S., dated 3/21/90, recorded in Plat Book 48, Page 166 Coweta County, Georgia records. Also a perpetual, non-exclusive easement for the purpose of pedestrian and vehicular ingress and egress over, across and through the 20 foot existing dirt road leading to and across said property from Standing Rock Road shown on plat of survey by John R. Christopher referenced herein and a perpetual, non-exclusive easement for the same purposes over across and through the area designated as a 25 foot easement being more particularly described as follows: Beginning at a point located on the West line of Land Lot 258 of the 1st Land District which point is N 00 degrees 30'16" W 388.46 feet from the SW corner of Land Lot 258 and from said point run N 00 degrees 30' 16" W 25.00 feet to a point; thence run N 89 degrees 00'00" E 636.24 feet to an iron pin found; thence continuing N 89 degrees 00'00'' E 291.60 feet to a point located in the centerline of a 20 foot existing dirt road; thence run S 12 degrees 10'45" E 25.48 feet to a point; thence run S 89 degrees 00'00" W933.0 feet to the POINT OF BEGINNING. Known as 5.000 Acres, Hugh Brown Road, Senoia, Coweta County, Georgia The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed as well as all other indebtedness owed the Lender. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of the sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
