NOTICE OF SALEUNDER POWER GEORGIA, COLQUITT COUNTY Because of a default in the payment of the indebtedness, among other possible events of default, contained in a Deed to Secure Debt from Lyle N. West and Gina M. West to Commercial Banking Company dated February 8, 2010 and recorded in Deed Book 1069, Page 1, Colquitt County records, securing a note in the original principal amount of $66,160.50, the holder thereof pursuant to said deed and note has declared the entire amount of said indebtedness (including all renewals, modifications and extensions) due and payable and pursuant to said power contained in said deed will on the first Tuesday in October, 2016, during the legal hours of sale before the Courthouse door in said County, sell at public outcry to the highest and best bidder for cash the following property to-wit: One city lot in the City of Moultrie, Colquitt County, Georgia, said lot being part of Block No. 393 of said city according to a plat of said city by O.H. Lang, C.E., of date of 1930 and being a part of Block 395 according to the Arthur survey of the city as shown by plat recorded in the Office of the Clerk of the Superior Court of Colquitt County, Georgia, in Deed Book W, Pages 798-799, and being more particularly described as follows: Beginning at the southeast intersection of First St, S.E. and Ninth Ave, S.E., and from said point run south along the east margin of First St., S.E., a distance of 67 feet and 3 inches; thence run east a distance of 97 feet and 4 inches; thence run north a distance of 3 feet and 13 inches; thence run east a distance of 23 feet and 8 inches; thence run north 63 feet and 5 inches to the south margin of Nineth Ave, S.E. 121 feet to the southeast intersection of First St., S.E. and Ninth Ave, S.E., being the POINT OF BEGINNING. Said property is known and designated as 903 1st Street SE, Moultrie, Georgia 31768. Said property will be sold subject to all applicable restrictive covenants and/or easements of record and any taxes or assessments which may be a lien against said property. In addition said property will be sold subject to any matters which might be disclosed by an accurate survey and inspection of the property and to all matters of record in the Office of the Clerk of the Superior Court of said county. Notice has been given of the Holders intention to collect attorneys fees in accordance with the terms of the note and the security deed. Said property will be sold as the property of Lyle N. West and Gina M. West and the property, to the best information, knowledge and belief of the undersigned being presently in the possession of Lyle N. West and Gina M. West. Proceeds of the sale will be applied to the payment of all indebtedness collateralized by said security deed and all expenses of said sale, including attorneys fees as provided in said security deed, and the balance, if any, will be distributed as provided by law. The following information is being provided in accordance with O.C.G.A. 44-14-162.2. Commercial Banking Company is the secured creditor under the security deed or deed to secure debt and loan being foreclosed.
