NOTICE OF SALEUNDER POWER GEORGIA, COLQUITT COUNTY By virtue of a Power of Sale contained in that certain Security Deed from JAMES HARMON to BNC MORTGAGE INC. A CALIFORNIA CORPORATION, dated November 26, 1997, recorded December 3, 1997, in Deed Book 596, Page 352, Colquitt County, Georgia Records, said Security Deed having been given to secure a Note of even date in the original principal amount of Nineteen Thousand Six Hundred and 00/100 dollars ($19,600.00), with interest thereon as provided for therein, said Security Deed having been last sold, assigned and transferred to Bayview Loan Servicing, LLC a Delaware Limited Liability Company, there will be sold at public outcry to the highest bidder for cash at the Colquitt County Courthouse, within the legal hours of sale on the first Tuesday in October, 2016, all property described in said Security Deed including but not limited to the following described property: TWO ACRES, MORE OR LESS, IN LAND LOT 68 IN THE 8TH LAND DISTRICT OF COLQUITT COUNTY, GEORGIA, MORE PARTICULARLY DESCRIBED AS FOLLOWS: FOR A POINT OF BEGINNING, FROM THE ORIGINAL SOUTHEAST CORNER OF LAND LOT NO. 68 IN THE 8TH LAND DISTRICT RUN NORTH 1 DEGREE WEST ALONG THE ORIGINAL EAST LOT LINE OF SAID LOT 1100 FEET TO A POINT IN THE CENTER OF A COUNTY PUBLIC ROAD, THENCE RUN NORTH 80 DEGREES WEST 2307.9 FEET, THENCE RUN SOUTH 6 DEGREES 39 MINUTES EAST 141.94 FEET,THENCE RUN NORTH 83 DEGREES 21 MINUTES WEST 245.14 FEET, THENCE RUN SOUTH 6 DEGREES 39 MINUTES WEST 371.29 FEET TO THE POINT OF BEGINNING AND FROM SAID POINT OF BEGINNING RUN SOUTH 83 DEGREES 21 MINUTES EAST 226.5 FEET, THENCE RUN SOUTH 6 DEGREES 39 MINUTES WEST 374.19 FEET, THENCE RUN NORTH 89 DEGREES 1 MINUTE WEST 227.62 FEET, THENCE RUN NORTH 6 DEGREES 39 MINUTES EAST 396.672 FEET TO THE POINT OF BEGINNING. Said legal description being controlling, however the property is more commonly known as 124 TIMBERLAND RD AKA 124 TIMBER LANE, NORMAN PARK, GA 31771. The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys fees (notice to collect same having been given) and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold on an as-is basis without any representation, warranty or recourse against the above-named or the undersigned.
