NOTICE Magistrate Court of Ben Hill County, State of Georgia, Ben Hill County Georgia, Plaintiff, vs. Edward E. Boysel, Merle L. Boysel & Southtrust Bank National Association Defendant(s). File No.. 16-23333A Notice for Publication TO: Edward E. Boysel, Merle L. Boysel, and SouthTrust Bank National Association, defendants, and all other persons owning or in possession of or claiming any interest in or right, title, claim or demand against the hereinafter described Property, and all lienors, tenants and lessees thereof, and all other persons having an interest in or a claim to the Property: Notice is hereby given that a complaint in rem was filed by Ben Hill County, Georgia (the “County”) against Edward E. Boysel, Merle L. Boysel, and SouthTrust Bank National Association, Defendants, on the 5th day of August, 2016, in the Magistrate Court of Ben Hill County, Georgia. Said complaint is available for inspection and copying in the office of Magistrate Court, 255 Appomattox Road, Fitzgerald, GA 31750, between 8:00 a.m. and 5:00 p.m., Monday through Friday. In said suit the County seeks relief (consisting of the abatement of certain alleged nuisances) against certain real property that is more particularly described as follows: All of Lot Number One (1) in Lynnwood Heights Subdivision, Block A in Land Lot Number 150 in the Third Land District of Ben Hill County, Georgia, and being shown on the plat of said Subdivision dated February 16, 1966, and revised November 11, 1967, and further revised September 25, 1968, and recorded in the Office of the Clerk of the Superior Court of Ben Hill County, Georgia, in Plat Book 5, Page 109, and particularly described as beginning at the southwest corner of the intersection of that certain public road known as Cedar Lane with that certain public road known as the Old Airport Road and which point is marked by an iron stake, thence south 00 degrees 35 minutes 50 seconds west along the west margin of Cedar Lane 121 feet to Lot Number 2 and which point is marked by an iron stake; thence north 89 degrees 12 minutes 40 seconds west 150 feet along the north margin of said Lot Number 2 to an alley and which point is marked by an iron stake; thence north 05 degrees 04 minutes 43 seconds east along the east margin of said alley 121.6 feet to the Old Airport Road and which point is marked by an iron stake; thence south 89 degrees 06 minutes 18 seconds east along the south margin of said Old Airport Road 140.50 feet to the point of beginning; and being the same property conveyed by Robert L. Smith and Margaret B. Smith to Melvin F. Williams, Jr., and Angela M. Williams by warranty deed dated June 5, 1995, and recorded in Deed Book 337, pages 271-272, in said Clerk's Office and being the same property shown by plat prepared by M. Rhett Royal, Georgia Registered Land Surveyor, dated May 31, 1995. The abatement of nuisances may include the repair, alteration or demolition of dwellings, buildings, and other structures, and the imposition of a lien against the said property for the cost of repair, alteration, and/or demolition, including all court costs, appraisal fees, administrative costs incurred by the County in connection with this suit and all other costs necessarily associated with the abatement action, including restoration to grade of the real property after demolition. The address, if any, of said property is 122 Cedar Lane, Fitzgerald, GA 31750. The official tax map reference for said property is 12 1 1 1. You are hereby summoned and required to appear at a hearing to be held by this Court with respect to the foregoing complaint at the Ben Hill County Magistrate, 255 Appomattox Road, Fitzgerald, GA 31750, on the 13th day of September, 2016, at 2 o'clock, p.m., to show cause, if any there may be, why the relief prayed for in the above mentioned complaint should not be granted. You are further summoned and required to file with the Clerk of said Court and serve upon the Plaintiff's attorney, Kyle C. Cook, Jay, Sherrell, Smith, Braddy & Cook, P.C., P.O. Box 308, 101 East Pine Street, Fitzgerald, GA 31750, an answer to the foregoing complaint. Such answer must be filed prior at or prior to the commencement of said hearing.
