NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF GWINNETT By virtue of a Power of Sale contained in that certain Real Estate Deed to Secure Debt from Steven C. Carson to Peach State Bank & Trust, dated July 11, 2005, filed July 18, 2005, recorded in Deed Book 43574, Page 0261, Gwinnett County, Georgia Records, as may have been modified and/or renewed from time to time (hereinafter the Security Deed), the Security Deed being given to secure a Note dated July 11, 2005, between Steven C. Carson (borrower) and Peach State Bank & Trust (lender), in the original principal amount of Fifty-Five Thousand and 00/100 Dollars ($55,000.00), as may have been modified/renewed from time to time (hereinafter Note), with interest thereon as provided therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Gwinnett County, Georgia, within the legal hours of sale on the first Tuesday in September, 2016, the following described property: All that tract or parcel of land, situate, lying and being in Land Lot 178 of the 5th District of Gwinnett County, Georgia; beginning at a point marked by an iron pin located on the southerly right of way of U. S. Highway 29 (sixty [60] foot right of way), which point is 243.0 feet southwesterly from the intersection of U.S. Highway 29 and Village Way as measured along the southerly right of way of U.S. Highway 29; thence running South 32 degrees 00 minutes East, 200 feet to a point marked by an iron pin; thence running 100 feet southwesterly at a 90 degree angle with the previous course to a point marked by an iron pin; thence running northwesterly 200 feet at a 90 degree angle with the previous course to a point marked by an iron pin on the southerly right of way of U.S. Highway 29; thence running northeasterly 100 feet along the southerly right of way of U.S. Highway 29 to an iron pin at the point of beginning. Said property is commonly known as 421 East Crogan Street, Lawrenceville, Georgia 30046. To have and to hold the said bargained premises together with all improvements now situated or hereafter placed thereon, and all interest, right and equity which the party of the first part now or may hereafter have therein to the only proper use, benefit, and behoof of the said party of the second part, its successors, heirs and assigns forever, in fee simple. The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purposes of paying the same and all expenses of sale, as provided in the Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien on the property but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed.
