NOTICE OF POWER
OF SALE
Because of default in the payment of the indebtedness secured by a Deed to Secure Debt executed by ROBYN R. DAVIS and TERRY M. DAVIS, dated August 13, 2010, recorded in Gwinnett County Deed Records at Deed Book 50217, Page 0703, the undersigned, Wayne Schumacher and Jane Schumacher, pursuant to said deed and the Note thereby secured, have declared the entire amount of said indebtedness due and payable pursuant to the power of sale contained in said deed, will on the first Tuesday in September 2016 during the hours of sale, at the Courthouse door in Gwinnett County, Georgia, sell at public outcry to the highest bidder for cash, the property described in said deed, to wit:
ALL THAT TRACT OR PARCEL OF LAND lying and being in Land Lot 271 of the 7th District of Gwinnett County, Georgia (city of Sugar Hill) as shown and delineated on Survey for Jackie Green by Robert T. Black and Associates dated December 23, 1985, and being more particularly described as follows:
Beginning at an iron pin at a point on the southern right-of-way of Shirley Drive (50 foot right-of-way), said pin being North 55 degrees 04 minutes 24 seconds East, a distance of 110.00 feet, from the intersection of the southern right-of-way of Shirley Drive and the eastern right-of-way of West Roberts Drive (50 foot right-of-way); thence running South 26 degrees 12 minutes 42 seconds East, a distance of 199.49 feet, to an iron pin; thence running North 55 degrees 02 minutes 42 seconds East, a distance of 89.88 feet, to an iron pin; thence running North 25 degrees 49 minutes 06 seconds West, a distance of 199.66 feet, to an iron pin on the southern right-of-way of Shirley Drive, thence running South 55 degrees 04 minutes 24 seconds West along said right-of-way, a distance of 91.26 feet, to an iron pin, the place or point of beginning.
Loan Survey prepared by Pearson & Associates, Inc., dated June 5, 1986 discloses said property as Lot 2, Block C, as recorded in Deed Book 3320, Page 107, Gwinnett County, Georgia Records.
This debt secured by said Security Deed has been and is hereby declared due because of default and non-payment on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys fees.
Said property will be sold subject to any outstanding ad valorem taxes, special assessments, unpaid utility bills constituting liens against the property, and all security deeds, liens, and encumbrances existing when the above-described deed was filed for record. To the best of the undersigneds knowledge, information and belief, equitable title to this property is held by Wayne Schumacher and Jane Schumacher.
Notice has been given of the initiation of proceedings to exercise the power of sale contained in the Deed to Secure Debt described above to the debtor not less than fifteen (15) days before the date of the proposed foreclosure sale. Said notice was sent in writing by Certified Mail, Return Receipt Requested, to the address previously designated by the Debtor, all in full and complete compliance with the requirement of Official Code of Georgia Sec. 44-14-162, et seq.
