UNDER POWER,
GWINNETT COUNTY
Pursuant to the Power of Sale contained in a Security Deed given by Robert B Jacobs and Bonnie S Jacobs to Bank of America, N.A. dated 3/9/2011 and recorded in Deed Book 50677 Page 390 Gwinnett County, Georgia records; as last transferred to or acquired by Federal National Mortgage Association (Fannie Mae), a corporation organized and existing under the laws of the United States of America, conveying the after-described property to secure a Note in the original principal amount of $ 293,700.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Gwinnett County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on September 06, 2016 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property:
ALL THAT TRACT OR PARCEL OF LAND tying and being in Land Lot 334, 7th District, Gwinnett County, Georgia, being part of Lot 9, Block A, Harbor Ridge Subdivision, according to plat prepared for Pyramid Development, Inc. by Ronald T. Godwin, RLS #2596, dated April 14, 1998 and being more particularly described as follows:
TO FIND THE TRUE POINT OF BEGINNING, begin at a point on the westerly arc of the cul-de-sac of Marina Way (50 R/W), said point being located southeasterly, southerly, westerly and northwesterly an distance of 319.23 feet from the intersection of the southeasterly right of way of Marina Way and the southwesterly right of way of Harbor Ridge Drive (50 R/W); running thence northeasterly along the northwesterly arc of the cul-de-sac of Marina Way an arc distance of 40.00 feet to a point (said arc being subtended by a chord bearing North 35 degrees 30 minutes 00 seconds East a distance of 38.94 feet); said point being the True Point of Beginning. From said True Point of Beginning, running thence northeasterly along the northerly arc of the cul-de-sac of Marina Way an arc distance of 42.05 feet to a point (said point being subtended by a chord bearing North 82 degrees 30 minutes 41 seconds East a distance of 40.83 feet); running thence northeasterly along the northerly arc of the cul-de-sac of Marina Way an arc distance of 21.03 feet to a point (said arc being subtended by a chord bearing North 82 degrees 30 minutes 41 seconds East a distance of 20.41 feet); running thence North 58 degrees 25 minutes 00 seconds East along the northwesterly right of way of Marina Way a distance of 174.77 feet to a point; running thence North 30 degrees 33 minutes 37 seconds West a distance of 175.03 feet to a point; running thence South 58 degrees 25 minutes 00 seconds West a distance of 267.08 feet to a point; running thence South 65 degrees 59 minutes 41 seconds East a distance of 46.30 feet to a point; running thence South 12 degrees 05 minutes 17 seconds East a distance of 43.74 feet to a point; running thence South 48 degrees 41 minutes 15 seconds East a distance of 73.83 feet to a point on the northwesterly arc of the cul-de-sac of Marina Way and the True Point of Beginning.
This conveyance is subject to all easements, restrictions and covenants of record, if any. Being that parcel of land conveyed to Robert B. Jacobs and Bonnie S. Jacobs, as joint tenants with rights of survivorship from Cendant Mobility Financial Corporation by that deed dated 7/1/2002 and recorded 7/17/2002 in deed book 28070, at page 42 of the Gwinnett County, GA public registry.
Being that parcel of land conveyed to Cendant Mobility Financial Corporation from Beth E. Introini and Richard A. Introini by that deed dated 6/12/2002 and recorded 7/17/2002 in deed book 28070, at page 40 of the Gwinnett County, GA public registry.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
Said property is commonly known as 1920 Marina Way, , Buford, GA 30518 together with all fixtures and personal property attached to and constituting a part of said property, if any. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is (are): Robert B Jacobs or tenant or tenants.
Seterus, Inc. is the entity or individual designated who shall have full authority to negotiate, amend and modify all terms of the mortgage.

Said property will be sold subject to: (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) unpaid water or sewage bills that constitute a lien against the property whether due and payable or not yet due and payable and which may not be of record, (c) the right of redemption of any taxing authority, (d) any matters which might be disclosed by an accurate survey and inspection of the property, and (e) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed. Pursuant to O.C.G.A. Section 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and non-judicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided immediately above.
