CLASS:007 NOTICE OF SALE UNDER POWER Coweta County, Georgia Under and by virtue of the Power of Sale contained in that certain Security Deed given by Sharpsburg Lane, LLC, a Georgia limited liability company (“Grantor”) to Regions Bank, an Alabama banking corporation (“Lender”) dated September 3, 2013 and recorded September 6, 2013 in Deed Book 4006, Page 392, Coweta County, Georgia official records (the “Security Deed”), conveying the property described below to secure repayment of that certain Promissory Note dated September 3, 2013 made payable by Grantor to the order of Lender in the original principal amount of $976,650.00, together with interest thereon as set forth therein (including any amendment, extension, modification, and renewal of any debt instrument evidencing same, the “Secured Indebtedness”), there will be sold at public outcry to the highest bidder for cash before the Courthouse door of Coweta County, Georgia, within the legal hours of sale on the first Tuesday in September, 2016 (being September 6, 2016) the following described property located in Coweta County, Georgia, together with all improvements, personalty, fixtures, easements, hereditaments, rights, members, and appurtenances located thereon and described in the Security Deed (collectively, the “Property”): All that tract or parcel of land lying and being in Land Lot 59 of the 6th District of Coweta County, Georgia, and being more particularly described as follows: TO FIND THE POINT OF BEGINNING, begin at an iron pin located at the intersection of the Eastern right-of-way line of Georgia Highway No. 154 (an 80.00 foot right-of-way) with the Southwestern right-of-way line of Georgia Highway No. 34 (a 115.00 foot right-of-way)) and run along said right-of-way line of Georgia Highway No. 34, South 80° 18' 40” East a distance of 362.10 feet to a point; thence continue along said right-of-way line of Georgia Highway No. 34, South 80° 18' 40” East a distance of 402.97 feet to a point; thence continue along said right-of-way line of Georgia Highway No. 34 South 80° 18' 40” East a distance of 217.30 feet to a point; thence continue along said right-of-way line of Georgia Highway No. 34 South 80° 18' 40” East a distance of 78.86 feet to a point, said point also being the POINT OF BEGINNING; thence leave said right-of-way line of Georgia Highway No. 34 and run South 34° 49' 52” West a distance of 60.76 feet to a point; thence run South 09° 41' 20” West a distance of 182.16 feet to a point; thence run along the arc of a curve to the right (said curve having a radius of 118.51 feet and being subtended by a chord bearing South 34° 42' 24” West and having a chord distance of 100.23 feet) an arc distance of 103.49 feet to a point; thence run South 71° 05' 00” East a distance of 180.75 feet to a point; thence run along the Western property line of property not or formerly owned by W. Robert Hancock, Jr. and John Herbert Cranford North 09° 52' 27” East a distance of 357.30 feet to a point located on the Southwestern right-of-way line of Georgia Highway No. 34 (a 115.00 foot right-of-way); thence run along said right-of-way line of Georgia Highway No, 34 along the arc of a curve to the left (said curve having a radius of 3652.97 feet and being subtended by a chord bearing North 80° 59' 45” West and having a chord distance of 27.79 feet) an arc distance of 27.79 feet to a point; thence continue along said right-of-way line of Georgia Highway No. 34 North 80° 18' 40” West a distance of 83.58 feet to a point, said point also being the POINT OF BEGINNING. Sanitary Sewer Easement Agreement by and between Bronze/Highway 34 Associates, L.P., a Georgia limited partnership, and SpartanBlock, LLC, a South Carolina limited liability corporation (sic), dated September 29, 1995, recorded in Deed Book 970, Page 542, aforesaid records. Access Easement Agreement by and between W. Robert Hancock, Jr. and John Herbert Cranford and SpartanBlock, LLC, a South Carolina limited liability company, dated April 20, 1999, recorded in Deed Book 1379, Page 227, aforesaid records. Being the same property conveyed to Sharpsburg Lane, LLC, a Georgia limited liability company, by virtue of a Limited Warranty Deed from 20 Dixie Lane N-GA, LLC, a Florida limited liability company, dated September 3, 2013, recorded September 6, 2013 in Book 4006, Page 388, Coweta County, Georgia Records. Parcel No: 121 6059 062 Commonly known as: 20 Dixie Ln., Sharpsburg, GA 30277 The above-described property is real and personal property located at 3161 Hwy. 34 East, Newnan, GA 30265-2120 formerly known as 20 Dixie Lane, Sharpsburg, Georgia 30277 according to the present system of numbering property in Coweta County, Georgia. The debt secured by the Security Deed has been and is hereby accelerated and declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the instruments evidencing the Secured Indebtedness and Security Deed. The debt remaining in default, the sale will be made for purposes of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (written notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the Security Deed.
