NOTICE OF SHERIFF'S SALE State of Georgia County of Fannin Pursuant to an Order of the Superior Court of Fannin County entered on the 16th day of December, 2013, in the matter of Gary E. Schraut and John Dunson, as class representative, Plaintiffs versus E. Renee Bidez, as executor of the Estate of Roy Quintrell, Defendant, the same being entered in Civil Action No. 2008-V-1021, and having been issued by the Honorable Murphy Miller, Judge sitting by designation in the Fannin County Superior Court, Appalachian Judicial Circuit, and the same being filed for record by the Clerk of the Superior Court for Fannin County Georgia, Dana C. Chastain on the 16th day of December, 2013 and also being filed for record by said Clerk in the Office of the Clerk of the Superior Court for Fannin County, Georgia, in Deed Book 1079, pages 281-282, Writ of Fieri Facias having been issued on the 17th day of December, 2013 and being recorded in Lien Book 37, page 116 in the Office of the Clerk of the Superior Court for Fannin County, Georgia, the Sheriff of Fannin County, the Honorable Dane Kirby, will on the first Tuesday in September, 2016, during the legal hours of sale at the courthouse door of Fannin County, Georgia, sell at public outcry to the highest bidder for cash the following property in satisfaction of said Order: Tract I: All that tract or parcel of land lying and being in the 8th District and 2nd Section of Fannin County, Georgia and being a part of Land Lot No. 181, 182, 215 and 216 and being more particularly described as Lot No. 278 of My Mountain, Phase II containing 1.43 acres of land as shown on a plat of survey prepared for Roy Quintrell by Lane S. Bishop, G.R.L.S. No. 1575, dated September 8, 2011, and recorded in plat hanger E-286, page 5, office of the clerk of Superior Court of Fannin County, Georgia. Said plat of survey is incorporated herein by reference for a more complete and accurate description of the above described property.Beginning at a rock at the north east corner of land lot No. 182; thence South 41 44' 9" W a distance of 3826.66 feet to an iron pin on the easterly right-of-way of a 20 foot asphalt Concrete Road (40 foot right-of-way); thence along and with said right of way the following two courses: thence along an arc of a curve to the right of a distance of 128.51 feet subtended by a chord S 25 47' 58" W a distance of 95.95 feet, having a radius of 50 feet to a yellow Pine tree thence along the arc of a curve to the right a distance of 104.14 feet subtended by a chord N 20 53'55" W a distance of 86.31 feet, having a radius of 50 feet to a point; thence N 48 13'25" W a distance of 157.84 feet to an iron pin and corner and the true point of beginning; thence N 63 15'15" W a distance of 159.30 feet to an iron pin and corner; Thence N 17 13'15" E a distance of 45.42 feet to a point and corner; thence S 48 13'25" E a distance of 172.73 feet to the true point of beginning. Said property being improved property and having a street address of 249 Evening Shadows Road Morganton, Georgia 30560 according to the current assignment of Fannin County, Georgia. Said property having a Parcel Number of 002504948 (Lot 279); 002504954 (lot 278); 002404956 (Lot 290); 002504977 (Tract IV and V collectively) according to the current system of the Fannin County Tax Assessors Office. The property will be sold as the property of John Dunson, a/k/a John Robert Dunson subject to the following: (1) all prior restrictive covenants, easements, right-of-ways, or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) all outstanding taxes, assessments, unpaid bills, charges and expenses that constitute liens against the property, whether due and payable or not yet due and payable. To the best of the undersigned's knowledge and belief, the party in possession is John Dunson, a/k/a John Robert Dunson, a tenant or tenants, or parties claiming under the aforementioned. Said property being levied upon as the property of John Dunson, a/k/a John Robert Dunson, as a Defendant in the aforesaid Judgment and Writ of Fieri Facias.
