NOTICE OF SHERIFF'S SALE STATE OF GEORGIA COUNTY OF EMANUEL Notice is hereby given that there will be a sale of the property described below in an attempt to satisfy that certain Judgment entered on May 17, 2016 in the United States District Court, Middle District of Georgia, Civil Action No: 3:15-CV-83-CDL (the “Judgment”), in favor of The Guarantee Company of North America (“Judgment Creditor”) against Pine Plantation, LLC, Gary's Grading & Pipeline Co., Inc., CGP Equipment Company, Inc., and Bold Springs, LLC, as evidenced by the Writ of Execution which was recorded on June 8, 2016 in Lien Book 71, Page 133, Emanuel County, Georgia records. The property described below which will be sold is in the interest of Pine Plantation, LLC, being the same entity as the Defendant Pine Plantation, LLC named in the Writ of Execution, which interest in the below-described real property Pine Plantation, LLC received by virtue of a Warranty Deed from William C. Schofill dated October 1, 2004, recorded in Deed Book 234, Pages 610-612, aforesaid records (the “Property”). Said Property will be sold by the undersigned at public outcry before the door of the Courthouse of Emanuel County, Georgia within the legal hours of sale on the first Tuesday in September 2016 to the highest and best bidder for cash. The Judgment Creditor shall be permitted to bid. The Property to be sold is described as follows: PARCEL 1 ALL THAT TRACT or parcel of land lying, situate and being in the 57th G.M. District of Emanuel County, Georgia, containing 251.942 acres, more or less, as shown on a plat of survey prepared by George William Donaldson, Surveyor, dated March 3, 2003, recorded in Plat Book 20, Slide 26-149, and to which plat referenced is hereby made for descriptive and all other legal purposes. The sale of the Property will be made for the express purpose of paying on the aforesaid Judgment, and purchasers pay for all title, transfer costs, taxes, advertising costs, and recording fees as allowed by Georgia law. The Judgment Creditor shall be permitted to bid. In the event that the Judgment Creditor is the highest bidder and purchaser of the Property, Judgment Creditor shall be permitted to credit the proceeds from the sale to the Judgment in lieu of payment in cash. The Property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the Property, any assessments, liens, encumbrances, zoning ordinances, restrictions, easements, covenants, and matters of record superior to the Writ of Execution. The property, or any portion thereof, may be possessed by Pine Plantation, LLC. Notice of levy and sale has been given to Pine Plantation, LLC as required by law. Sheriff J.
