NOTICE OF SALE UNDER POWER State of Georgia, County of Ben Hill Because of a default under the terms of the Security Deed executed by Bonnie O. Turner to CitiFinancial Services, Inc. dated May 31, 2006, and recorded in Deed Book 632, Page 160, Ben Hill County Records, said Security Deed having been last sold, assigned, transferred and conveyed to CitiFinancial Servicing, LLC, securing a Note in the original princi- pal amount of $69,360.99, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, September 6, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All of Lot 40 In Roanoke Acres, Subdivision No. 11 lying and being in Land Lot 118 in the 3rd Land District of Ben Hill County, Georgia, as shown by the plat of said subdivision approved by the Fitzgerald, Ben Hill County Planning Commission on May 31, 1972, and recorded on June 1, 1972, in Plat Book 7, Page 58, in the office of the Clerk of the Superior Court of Ben Hill County, Georgia. Said plat is made reference to and incorporated herein as part of this description. Grantor herein has agreed with the City of Fitzgerald that the land conveyed hereby be brought into the city limits of the City of Fitzgerald, Georgia, and that the city limits of said city be extended so as to include the lands hereby conveyed, and the grantees herein, by their acceptance of this deed, do consent and agree that said lands be brought within the city limits of said city and do hereby agree that any and all action necessary be taken so as to bring said lands within the corporate limits of said city. This paragraph shall be deemed to be a covenant running with the land and shall be binding not only on the grantees herein but all subsequent owners of the above described property. Said property is known as 118 Snowden Lane, Fitzgerald, GA 31750, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
