NOTICE OF SALE UNDER POWER State of Georgia, County of Ben Hill Because of a default under the terms of the Security Deed executed by Richard A. Reese and Lucienne Y. Reese to Mortgage Electronic Registration Systems, Inc., as nominee for E-Loan, Inc., its successors and assigns dated May 29, 2007, and recorded in Deed Book 668, Page 180, Ben Hill County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Nationstar Mortgage LLC, securing a Note in the original principal amount of $128,250.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, September 6, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: A tract of land located in Land Lot 121 in the 3rd Land District of Ben Hill County, Georgia more particularly described as follows: TO OBTAIN THE POINT OF BEGINNING, commence at the intersection of the centerlines of Jack Allen Road West and Wilson Avenue (60' R/W); thence in a southerly direction along the centerline of Wilson Avenue 326.14 feet; thence north 89°19'22" west 30.00 feet to a point located on the west right of way line Wilson Avenue and the point and place of beginning. From said point and place of beginning thence continue along the west right of way line of Wilson Avenue south 00°32'38" west 657.39 feet; thence north 89°34'27" west 425.61 feet; thence north 00°33'12" east 208.50 feet; thence north 89°34'27" west 208.50 feet; thence north 00°33'12" east 451.67 feet; thence south 89°19'22" east 634.00 feet to the Point and Place of Beginning. Said tract contains 8.59 acres and is more particularly delineated upon a plat of survey entitled "Survey for Richard A. Reese and Lucienne Y. Reese" made by Sunbelt Surveyors, Inc. dated May 21, 2007 and recorded in Plat Slide 682-G2 in the office of the Clerk of the Superior Court of Ben Hill County, Georgia. Said property is known as 126 Wilson Avenue, Fitzgerald, GA 31750, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
