NOTICE OF SALE UNDER POWER GEORGIA, GLYNN COUNTY THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by Brian G. Smith to Mortgage Electronic Registration Systems, Inc., as nominee for American Mortgage Network, Inc., dated 06/08/2005, recorded in Deed Book 1696, Page 154, Glynn County, Georgia records, as last transferred to DREAM Capital Management, LLC, as Trustee for the DCFI NPN2 0215001 Trust by assignment recorded or to be recorded in the Glynn County, Georgia records conveying the after-described property to secure a Note in the original principal amount of One Hundred Fourteen Thousand Six Hundred and 00/100 DOLLARS ($114,600.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Glynn County, Georgia, within the legal hours of sale on the first Tuesday in September 2016, the following described property: All that certain lot, tract or parcel of land situate, lying and being on St. Simons Island, in Glynn County, Georgia described and identified according to the map and plan of St. Simons Heights Subdivision dated December 12, 1925, by R.W. Cowan, Civil Engineer, which is recorded in the Office of the Clerk of Superior Court of Glynn County, Georgia, at Deed Book 3-U, commencing at page 147, as said plat entitled "Final Subdivision Replat of a portion of St. Simons Heights by Park D. Privett, Jr., Georgia Registered Surveyor No. 2218, dated August 15, 1984, recorded in said Clerk`s Office at Plat Drawer No. 19, Map No. 1009, the lot herein conveyed as described according to said plat and amended plat as ALL OF LOT FOUR (4), BLOCK "F", ST. SIMONS HEIGHTS SUBDIVISION. Said property being the same property conveyed under deed from F. James Funk, Jr., to Austin Trupp dated May 12, 1997 and recorded in the Office of the Clerk of Superior County, Glynn County, Georgia in Deed Book 242, Page 062, and subsequently conveyed under deed from Austin Trupp to Thomas Bradford Barwise and Pamela J. Barwise dated October 31, 2000 and recorded in the Clerk of Superior Court, Glynn County, in Deed Book 722, at page 562. Subject to prior security deed at Deed Book 1499, Page 199, aforesaid records, as assigned at Deed Book 2924, Page 485, and Deed Book 3119, Page 436, aforesaid records. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. Please understand that the secured creditor is not required by law to negotiate, amend, or modify the terms of the mortgage instrument.
