STATE OF GEORGIA COUNTY OF GLYNN NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by Elizabeth S. Young to PHH Mortgage Services dated October 24, 2006, and recorded in Deed Book 2084, Page 358, and Deed Book 2084, Page 358, Glynn County Records, said Security Deed having been last sold, assigned, transferred and conveyed to HSBC Bank USA, National Association as Trustee for PHH 2007-1, securing a Note in the original principal amount of $146,400.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, September 6, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: ALL THAT CERTAIN REAL PROPERTY situate, lying and being on St. Simons Island, in Glynn County, Georgia, and being UNIT NUMBER TEN (10), BUILDING "P" OF OCEAN WALK, A CONDOMINIUM, (the "Unit") as shown on that certain Condominium Plat dated April 29, 1997, (last revised September 13, 1998), prepared by Freeman-Vaughn Engineering, Inc., certified by Michael A. Hussey, Georgia Registered Land Surveyor No. 2509, recorded in Plat Drawer 25, Map No. 56, in the Office of the Clerk of Superior Court in Glynn County, Georgia. The Unit is a part of the property described in Exhibit "A" to the Declaration of Condominium for Ocean Walk, A Condominium, dated October 7, 1998, and recorded in Deed Book 553, Page 85, aforesaid records (the "Declaration"). THE UNIT INCLUDES an undivided interest in the common elements of Ocean Walk, A Condominium, as set forth in the Declaration, together with all of the right, title and interest of Grantor in said Unit and the appurtenances thereto under said Declaration. THE ABOVE-DESCRIBED Condominium Plat, the Declaration of Condominium and any recorded amendments thereto, or other documents which comprise a part of the Condominium Instruments are incorporated herein and made a part hereof. Any reference to the Declaration made in this deed shall be deemed to include any recorded amendments thereto, THIS CONVEYANCE is made subject to the terms, provisions, and restrictions contained in the Georgia Condominium Act, Georgia Laws, 1975, Page 609, as amended from time to time, and in the Declaration. By the acceptance of this Deed, Grantees acknowledge receipt of a copy of said Declaration and agree to comply with all of the terms, provisions, and restrictions set forth therein, as amended from time to time, Said property is known as 850 Mallery Street P10, Saint Simons Island, GA 31522, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
