NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by Paula Jan Sears and Patrick Brian Wigley to Mortgage Electronic Registration Systems, Inc. as nominee for Taylor, Bean and Whitaker Mortgage Corp. dated April 5, 2007, and recorded in Deed Book 2198, Page 197, Glynn County Records, said Security Deed having been last sold, assigned, transferred and conveyed to HSBC Bank USA, National Association as Trustee for Wells Fargo Asset Securities Corporation, Mortgage Pass-Through Certificates, Series 2007-13, securing a Note in the original principal amount of $493,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, September 6, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All that certain tract or parcel of land situate, lying and being in the 27th G.M. District of Glynn County, Georgia, containing 9.28 acres, and being a portion of the "Resubdivision of Blythe Island Subdivision" and more particularly described as follows: Beginning at the southwest intersection of Blythe Island Drive and Peninsula Drive, thence North 86 degrees 00 minutes 12 seconds West a distance of 477.31 feet to an iron pin; thence South 3 degrees 04 minutes 32 seconds West a distance of 372.68 feet to an iron pin and the point or place of beginning; thence South 3 degrees 04 minutes 32 seconds West a distance of 172.69 feet to an iron pin; thence South 64 degrees 00 minutes 01 seconds West a distance of 745.26 feet to a concrete monument; thence South 22 degrees 02 minutes 08 seconds East a distance of 18.24 feet to a concrete monument; thence South 63 degrees 27 minutes I 2 seconds West a distance of 636.53 feet to a concrete monument; thence North 43 degrees 20 minutes 51 seconds West a distance of 139.93 feet to an old stake; thence North 35 degrees 50 minutes 00 seconds East a distance of 600.27 feet to a concrete monument; thence North 77 degrees 51 minutes 47 seconds East a distance of 1,008.86 feet to the point or place of beginning. For a further description of said land a reference is made to that map made on June 25, 1985, and filed in Plat Drawer 19, Plat 1135, in the public records of Glynn County, Georgia, and that certain plat of "Resubdivision of Blythe Island Subdivision under date of April 30, 1986, and filed in Plat Drawer 19-A, Plat 1259, in the public records of Glynn County, Georgia. Said property being the identical property conveyed to Deron Roberts and Jeanette Roberts by Warranty Deed dated July 16. 1986, from Lee D. Davis and Carroll L. Bennett, recorded in Book 27-T, Page 571; Quitclaim Deed dated December 29, 1995, from Jeanette Roberts to Deron Roberts recorded in Book 61-P, Page 223; Quitclaim Deed dated January 11, 1995, from Deron Roberts to Jeanette Roberts recorded in Book 62-B, Page 215; and Warranty Deed dated June 30, 1999, from Jeanette Roberts n/k/a Jeanette Monte to Deron Roberts recorded in Book 594, Page 485, Office of the Clerk of the Superior Court of Glynn County, Georgia. Said property is known as 150 Blythe Cove, Brunswick, GA 31523, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor. The property is or may be in the possession of Paula Jan Sears, a/k/a Paula J. Sears and Patrick Brian Wigley, successor in interest or tenant(s).
