UNDER POWER
MARION COUNTY
Pursuant to the Power of Sale contained in a Security Deed given by Tina P Apt to Flag Bank dated 12/28/2001 and recorded in Deed Book 133 Page 454 and modified at Deed Book 219 Page 225 Marion County, Georgia records; as last transferred to or acquired by Federal National Mortgage Association (Fannie Mae), a corporation organized and existing under the laws of the United States of America, conveying the after-described property to secure a Note in the original principal amount of $ 99,450.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Marion County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on August 02, 2016 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property:
PARCEL ONE
All that tract or parcel of land situate, lying and being in the Land Lot 96 of the 11th Land District of Marion County, Georgia, containing 9.77 acres, more or less, which is more particularly described as follows:
Start at the southwest corner of land Lot 96 in the 11th District of Marion County, Georgia, thence run south 89 degrees 32 minutes east, along the southern and lot line of Land Lot 96 of the 11th Land District of Marion County, Georgia, for a distance of 536.13 feet to the point of beginning; and from said point of beginning thence run north 60 degrees 30 minutes east, a distance 554.81 feet to an iron point; thence run north 60 degrees 17 minutes east 671.49 feet to a point; thence run north 61 degrees 59 minutes east 155.14 feet to a point; thence run south 23 degrees 37 minutes east 726.83 feet to a point which lies on the southern land lot line of Land Lot 96 in the 11th Land District of Marion County, Georgia, thence run along said land lot line south 89 degrees 30 minutes west a distance of 1494.21 feet to said POINT OF BEGINNING, which property is more particularly described in Plat Survey by James R. Littlefield, Georgia Registered Surveyor No. 1304, which plat is recorded in the deed records of the Superior Court of Marion County, Georgia, and made a part hereof by reference. Plat recorded in Plat Book C, Page 116.
PARCEL TWO
All that tract or parcel of land lying and being in Land Lot 96 of the 11th Land District, Marion County, Georgia, and further identified as Lot 1, containing 5.16 acres and having such shape, size, metes, bounds, courses and distance as are shown upon a plat entitled PROPERTY OF SOUTHERN LAND AND LUMBER COMPANY by James R. Littlefield, Georgia Registered Land Surveyor No. 1304, dated May 2, 1989, and recorded in Plat Book C, Page 162, Clerks Office, Marion County Superior Court. Reference is hereby made to said plat and incorporated herein for the purpose of a more particular and accurate description of the property herein conveyed.
Also conveyed is the manufactured housing unit located on said property.
LESS AND EXCEPT the property described in that certain Right-of-Way Deed dated November 10, 1972 between Property Management Services, Inc. and Marion County, Georgia, recorded in Deed Book 47, Page 187, in the Office of the aforesaid Clerk.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
Said property is commonly known as 574 Ft. Perry Road, Box Springs, GA 31801 together with all fixtures and personal property attached to and constituting a part of said property, if any. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is (are): Tina P Apt or tenant or tenants.
Seterus, Inc. is the entity or individual designated who shall have full authority to negotiate, amend and modify all terms of the mortgage.

Said property will be sold subject to: (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) unpaid water or sewage bills that constitute a lien against the property whether due and payable or not yet due and payable and which may not be of record, (c) the right of redemption of any taxing authority, (d) any matters which might be disclosed by an accurate survey and inspection of the property, and (e) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed. Pursuant to O.C.G.A. Section 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and non-judicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided immediately above.
