Pursuant to O.C.G.A. 44-3-232(c) of the Georgia Property Owners Act and the Writ of Fieri Facias entered by the Superior Court of Gwinnett County, Georgia on October 31, 2014; Civil Action No. 14-A-05231-6 and in favor of Sandalwood Townhomes Unit II Condominium Association, Inc. plaintiff and against Happy J. Vance, defendant, the below described property will be sold at public auction to the highest and best bidder for cash, between the legal hours of sale before the courthouse doors in Gwinnett County, Georgia, on the first Tuesday in August, 2016 to wit: August 2, 2016.
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 147 OF THE 5TH DISTRICT OF GWINNETT COUNTY, GEORGIA, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
CONDOMINIUM UNIT 29 OF SANDALWOOD TOWNHOMES, UNIT II, A CONDOMINIUM, AS MORE PARTICULARLY DESCRIBED AND DELINEATED IN THE DECLARATION OF CONDOMINIUM FOR SANDALWOOD TOWNHOMES, UNIT II, RECORDED IN DEED BOOK 2288, PAGE 13, ET SEQ., GWINNETT COUNTY, GEORGIA RECORDS, AS MAY BE AMENDED, TOGETHER WITH ALL RIGHT, TITLE AND INTEREST IN THE COMMON ELEMENTS AS SET FORTH IN SAID DECLARATION.
THIS CONVEYANCE IS MADE SUBJECT TO THE DECLARATION AND ALL MATTERS REFERENCED THEREIN, ALL MATTERS SHOWN ON THE PLAT RECORDED IN CONDOMINIUM PLAT BOOK 1, PAGE 55, GWINNETT COUNTY, GEORGIA RECORDS, AS MAY BE AMENDED, AND THE FLOOR PLANS RECORDED IN CONDOMINIUM FLOOR PLAN BOOK 81, AFORESAID RECORDS, AS MAY BE AMENDED. PROPERTY IS COMMONLY KNOWN AS 29 SANDALWOOD CIRCLE, LAWRENCEVILLE, GEORGIA 30046.
Said property having been found to be in the possession of the defendant, Happy J. Vance and levied upon as the property of the defendant in accordance with the Writ of Fieri Facias stated above.
The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record, which may affect said property.
The sale will be conducted subject to confirmation that the sale is not prohibited under the United States Bankruptcy Code.
