NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY of COWETA By virtue of the power of sale contained in that certain Deed to Secure Debt from BARBARA B. PHILLIPS to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR NBANK, N.A. dated July 24, 2003, filed for record October 21, 2003, and recorded in Deed Book 2352, Page 672, COWETA County, Georgia Records, as last transferred to WELLS FARGO BANK, N.A. by assignment recorded in Deed Book 3841, Page 778, COWETA County, Georgia Records. Said Deed to Secure Debt having been given to secure a Note dated July 24, 2003 in the original principal sum of SEVENTY FIVE THOUSAND AND 0/100 DOLLARS ($75,000.00), with interest from date at the rate stated in said Note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at COWETA County, Georgia, or at such place as has or may be lawfully designated as an alternative location, within the legal hours of sale on the first Tuesday in August, 2016, the following described property: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 54 OF THE FOURTH LAND DISTRICT OF COWETA COUNTY, GEORGIA, AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGIN AT A POINT ON THE EAST SIDE OF THE RIGHT-OF-WAY OF MURPHY ROAD WHERE THE SOUTH LINE OF LAND LOT 54 INTERSECTS SAID RIGHT-OF-WAY, AND RUN THENCE NORTH ALONG THE EAST SIDE OF SAID RIGHT-OF-WAY OF MURPHY ROAD, 08 DEGREES 00 MINUTES 00 SECONDS WEST, A DISTANCE OF 181.70 FEET TO AN IRON PIN FOUND; THENCE SOUTH 88 DEGREES 29 MINUTES 00 SECONDS EAST, A DISTANCE OF 242.00 FEET TO AN IRON PIN SET; THENCE SOUTH 08 DEGREES 00 MINUTES 00 SECONDS EAST, A DISTANCE OF 168.25 FEET TO THE SOUTH LINE OF LAND LOT 54 AND AN IRON PIN SET; THENCE ALONG THE SAID SOUTH LINE OF LAND LOT 54, 88 DEGREES 21 MINUTES 00 SECONDS WEST, A DISTANCE OF 240.14 FEET TO AN IRON PIN FOUND AND THE POINT OF BEGINNING. SAID PROPERTY CONTAINING APPROXIMATELY 0.96 ACRES. To the best of the knowledge and belief of the undersigned, the party in possession of the property is BARBARA B. PHILLIPS or a tenant or tenants. Said property may more commonly be known as: 557 MURPHY ROAD, NEWNAN, GA 30263. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees (notice of intent to collect attorney's fees having been given).
