STATE OF GEORGIA COUNTY OF FANNIN NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Security Deed from LILLY JANE BELL to UNITED FAMILY FINANCE n/k/a UNITED COMMUNITY BANK, dated November 29, 1996, recorded December 2, 1996, in Deed Book 256, Page 463, Fannin County, Georgia records, as last modified by Modification of Security Deed dated January 3, 2014, recorded January 30, 2014 in Deed Book 1082, Page 744, Fannin County, Georgia records, said Security Deed being given to secure a Note from LILLY JANE BELL and THOMAS A. BELL dated January 3, 2014, in the original principal amount of Twenty Seven Thousand Five Hundred Forty Four and 43/100 ($27,544.43) Dollars, with interest due thereon on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Fannin County, Georgia, within the legal hours of sale on the first Tuesday in August, 2016, the following described property: All that tract or parcel of property lying in the 8th District, 2nd Section of Fannin County, Georgia and being part of Land Lot 227.Beginning at the mouth of the branch at the river; thence west up the branch approximately 160 yards to a conditional rock corner; thence south with a conditional line approximately 160 yards to the north and south original line of said lot; thence south with said original line to the original corner of said Lot No. 227; thence with the old public road a general east direction for approximately 170 yards to an iron stake corner; thence a north east course to an iron stake at the branch; thence down the branch to the river; thence down the river to the beginning point, containing 50 acres, more or less. Being a portion of that property as conveyed by deed recorded in Deed Book 29, Page 198, Fannin County Records. Less and Except those certain properties as conveyed by deed recorded in Deed Book 35, Page 15; Deed Book 102, Page 195; Deed Book 175, Page 15 and Deed Book 118, Page 416, Fannin County records. The Grantor herein reserves for himself a Life Estate in and to the above described property including the right to utilize the property for and during his natural lifetime. (Grantor was Verlen Lewis, deceased April 17, 1994)The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
