NOTICE OF SALE UNDER POWER
By virtue of a lien and a power of sale contained in the amended Declaration of Covenants, Conditions and Restrictions of Winged Foot Condominium Association, Inc. as amended of file and record in Deed Book R-6 Pages 549 et. seq. and Deed Book F-38 Pages 89-93, in the Office of the Clerk of Rabun County Superior Court, and said Declaration providing for the assessment, payment and collection of certain maintenance fees and other charges due said Winged Foot Condominium Association, Inc. by the following owners with late charges and interest, and said charges to the following being past due and unpaid, demand by certified mail having been made upon them by the said Association, and payment refused, there will be sold by the undersigned at public outcry to the highest bidder, for cash before the Courthouse door in Rabun County, Georgia, within the legal hours of sale on the first Tuesday in July, 2016, the same being July 5, 2015, the following described property of the named owners:
Certain Interval Time Share Unit Weeks and all rights, title and interest pertaining thereto in Winged Foot Condominium Association, Inc. and the improved property located in the 2nd Land District, Land Lots 169, 170, 195 or 196 of Rabun County, Georgia known as Winged Foot Condominiums as is more fully shown on plats of same recorded in Condominium Plat Book 1, Page 253, in said Clerks Office owned by: Edwin Dean Gaston, Week B50, 1441 Brockman McClimon Road, Greer, S.C., 29651; Thomas R. Anderson, Week E4, 7120 E. Caron Drive, Paradise Valley, Arizona 85253-1977; Terri Corbett, Weeks F48 and C23, 907 E. Orange Ave. #18, Eustis, Florida 32726-6249; William Perry Davis, Week A 17, 6050 NW 4th Avenue, Boca Raton, Florida 33487; Pamela R. Freyermuth, Week E43, 2009 Stanley Street, Orlando, Florida 32803-6009; Nancy J. Turner, Week C38, 205 Blanca Avenue, Tampa, Florida 33606.
The said indebtedness has been and is hereby declared in default by reason of non-payment of said charges and assessments. The debts remaining in default, this sale will be made for the purpose of satisfying the same and all expenses of this sale, including attorneys fees.
Said property will be sold as the property of the named debtors subject to any and all ad valorem taxes, the right of redemption of any taxing authority, any matters which might be disclosed by a current and accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, security instruments and any other matters of record superior to the indebtedness described herein.
The sale will be conducted subject to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code.
The undersigned will execute a Deed Under Power of Sale to the purchaser at said sale.
