Legal 150 Advertisement Of Sale Under Power Georgia, Pike County: By virtue of the power and authority contained in a Security Deed and under the power of sale contained therein, executed by James F. Anderson, Sr. and Nina M. Anderson to First Bank of Pike, dated June 8, 2011, which is recorded in the Clerk's Office, Superior Court of Pike County, Georgia, in Deed Book 871, Page 169; said Georgia Security Deed and Security Agreement having been given to secure a Promissory Note dated February 20, 2014, with interest from date at the rate stated in said Promissory Note on the unpaid balance until paid, the undersigned will sell at public outcry to the highest bidder for cash at the courthouse in Zebulon, Pike County, Georgia, between the legal hours of sale on the first Tuesday in July, 2015 to-wit: July 5th, 2016, the following real estate: TRACT ONE: All that tract or parcel of land, together with all improvements located thereon, situate, lying and being in Land Lot 107 of the 9th Land District of Pike County, Georgia, and being more particularly described as follows: To find the point of beginning, begin at an iron pin at the common corner of Land Lots 85, 86, 107 and 108; and run thence north 89 degrees 53' 30” west a distance of 845.0 feet to an iron pin on the line common to Land Lots 107 and 108, which iron pin is the point of beginning: From the point of beginning thus established, running thence north 89 degrees 50' 30” west along the line common to Land Lots 107 and 108 a distance of 1002.8 feet to an iron pin; thence south 0 degrees 39' west a distance of 636.3 feet to an iron pin on the northerly right-of way line of Concord-Lifsey Springs Road (80 foot right-of-way); thence south 63 degrees 14' east along the northerly right-of-way line of Concord-Lifsey Springs Road a distance of 120.9 feet to a point; thence south 65 degrees 22' east along the northerly right-of-way line of Concord-Lifsey Springs Road a distance of 978.8 feet to an iron pin; thence north 0 degrees 39' east a distance of 1096.9 feet to the Point of Beginning. Said property is further accepted and conveyed subject to easements, including utilities and rights of way that actually traverse or border subject property. LESS AND EXCEPT: All that tract or parcel of land, consisting of 8.63 acres, together with all improvements, situate, lying and being in Land Lot 107, of the 9th Land District of Pike County, Georgia, and being more particularly shown on that certain plat of survey entitled, “Plat For Frank Anderson, Jr. and Cindy Anderson”, dated July 19, 2012, prepared by Robert A. Moreland, RLS, of record in Plat Book 30, Page 34, Clerk's Office, Superior Court, Pike County, Georgia, and having such size, shape, location, metes, bounds, courses and distances as shown on said plat of survey which by reference is incorporated into and made a part of this description as fully and completely as if copied at length herein. This is a portion of the identical real estate conveyed to Nina M. Anderson by Warranty Deed of W. Neal Bolton, dated June 14, 2002, of record in Deed Book 389, Page 202, said Clerk's Office. Said property is accepted and conveyed subject to easements, including utilities, and rights of way that actually traverse or border subject property. TRACT TWO: All that tract or parcel of land, together with all improvements located thereon, situate, lying and being in Land Lot 108 of the Ninth Land District, said tract being 22.0 acres and specifically shown as Tract “A” on that certain “Boundary Survey For W. Neal Bolton”, dated June 13, 2002, prepared by Marvin Douglas Gordon, Georgia Registered Land Surveyor, No. 2395. Copy of said plat being attached hereto marked as EXHIBIT “B”, in said Security Deed aforementioned, as recorded in Deed Book 389, Page 204 and incorporated herein by reference thereto, together with all metes, courses, boundaries and distances, as if fully and completely copied at length therein. This is the identical real estate conveyed to Nina M. Anderson by Warranty Deed of W. Neal Bolton, dated June 14, 2002, of record in Deed Book 389, Page 202, said Clerk's Office. LESS AND EXCEPT: All that lot, tract or parcel of land, together with all improvements located thereon, situate, lying and being in Land Lots 107 and 108 of the 9th Land District of Pike County, Georgia, being more particularly shown and designated as Tract 2, containing 3.00 acres as shown on a plat of survey entitled, “Survey For Christy Hammons And Joseph Ashley Mckoy” prepared by S. J. Reeves & Associates, Inc., more particularly Steve J. Reeves, Registered Land Surveyor No. 2765, dated May 15, 2008, recorded in Plat Book 26, Page 49, Pike County Superior Court records, which said plat together with the courses, distances, metes and bounds as shown thereon with the respect to Tract 2, is incorporated in and made a part of this description by reference. Said property is accepted and conveyed subject to easements, including utilities, and rights of way that actually traverse or border subject property. EASEMENT AGREEMENT It is expressly agreed by the grantor that as consideration of this loan at the option of the herein named grantee, that grantor shall by deed, convey an easement at least thirty feet in width across other properties of grantor (Tract One), said easement shall be for ingress and egress purposes to said tract described in (Tract Two) herein. Said option shall remain in effect as long as grantee shall hold a security interest in said property. Any cost of survey, deed preparation, recording or any other cost incurred in establishing said easement shall be the responsibility of the herein named grantor. The debt secured by said Security Deed and note has been and is hereby declared due and payable in full because of nonpayment of indebtedness secured thereby pursuant to the terms of said Deed to Secure Debt and Note. Notice has been given of intention to enforce provisions for collection of attorney's fees and foreclosure in accordance with the legal requirements of the Deed to Secure Debt and Note(s). The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Deed to Secure Debt, accrued interest and expenses of the sale and other sums secured by the Deed to Secure Debt, including attorney's fees, and the remainder, if any, shall be applied as provided by law. To the best of the undersigned's knowledge and belief, the property is in the possession of and will be sold as the property of James F. Anderson, Sr. and Nina M. Anderson, (both deceased), in C/O Eugene W. Dabbs, IV., as Pike County Administrator, C.T.A., of both the Estates of James F. Anderson, Sr. and Nina M. Anderson, with a mailing address known as 1195 Roberts Quarters Road, Concord, GA 30206/P.O. Box 94, Concord, GA 30206, and in C/O Gene Dabbs, 329 South Hill Street, Griffin, GA 30224. The sale will be conducted subject: 1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, and, 2) to final confirmation and audit of the status of the loan with the holder of the Georgia Security Deed and Security Agreement.
