NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF RICHMOND Under and by virtue of the power of sale contained with that certain Security Deed dated July 31, 2009, from Carolyn E. Ruff to Mortgage Electronic Registration Systems, Inc., as nominee for Lend America, a New York Corporation, recorded on September 17, 2009 in Deed Book 1231 at Page 1865, as last modified by Loan Modification Agreement recorded in Deed Book 1440, at Page 260, Richmond County, Georgia Records, having been last sold, assigned, transferred and conveyed to Selene Finance LP by Assignment and said Security Deed having been given to secure a note dated July 31, 2009, in the amount of $133,444.00, having a modified loan amount of $105,801.41, said note and modification thereof being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Richmond County, Georgia, on July 5, 2016, the following described real property (hereinafter referred to as the "Property"): ALL THAT LOT OR PARCEL OF LAND WITH IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN THE STATE OF GEORGIA, COUNTY OF RICHMOND, BEING SHOWN AND DESIGNATED AS LOT 28, BLOCK A, OF SAND RIDGE SUBDIVISION, SECTION 1, ON A PLAT RECORDED IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF RICHMOND COUNTY, GEORGIA, IN REEL/BOOK 216, PAGES 918-921; REFERENCE BEING MADE TO SAID PLAT FOR A MORE COMPLETE AND ACCURATE DESCRIPTION AS TO THE METES, BOUNDS AND LOCATIONS OF SAID PROPERTY. TAX ID#: 139-0-123-00-0 The debt secured by the Security Deed and evidenced by the Note and has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Security Deed, accrued interest, and all expenses of the sale, including attorneys' fees. Notice of intention to collect attorneys' fees has been given as provided by law. To the best of the undersigned's knowledge, the person(s) in possession of the property is/are Carolyn E. Ruff. The property, being commonly known as 2704 Fair Oak Court, Hephzibah, GA, 30815 in Richmond County, will be sold as the property of Carolyn E. Ruff, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.
