NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY By virtue of Power of Sale contained in the Deed to Secure Debt and Note from Shrryia Enterprise, Inc. ("Borrower") to Elizabeth Anne Lofton, Barbara Nuite Auld, Carolyn Clarke Nuite and Charlotte Nuite Kitchen ("Lenders"), dated June 24, 2015, and filed for record July 20, 2015 and recorded in Book 1493, page 1498 in the Office of the Clerk of the Superior Court of Richmond County, Georgia, the Lender has called the Note due and payable. Said Deed to Secure Debt being given to secure a Note of even date in the original principal amount of Forty Thousand and No/100 Dollars ($40,000.00) with interest from date at the rate as provided therein on the unpaid balance until paid there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Augusta, Richmond County, Georgia, within the legal hours of sale on July 5, 2016. The security being: ALL THAT TRACT OR PARCEL OF LAND, with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, being known and designated as Tract "A" containing 23.63 acres, more or less, as shown on a plat thereof recorded in the Office of the Clerk of Superior of Richmond County, Georgia in Book 655, pages 511-512. Reference is being made to said plat for a more complete and accurate description as to the metes, bounds and location of said property. Said property is known under the present system of street numbering in Augusta-Richmond County, Georgia as 2651 Tobacco Road, Hephzibah, GA 30815. This property is conveyed subject to any Restrictions, Easements and Right of Ways of record and to include documents recorded in Book 21 Q, page 50, Book 37 G, page 50, Book 37 G, page 429, Reel 127, page 2208, Book 436, page 2279, said Clerk's Office. Tax Map/Parcel Number: 140-0-706-03-0 The debt secured by the Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to comply with the terms of the Note, to include non-payment, as required by the Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys' fees. To the best knowledge and belief of Lender, the above described property is in the possession of Shrryia Enterprise, Inc. The property will be sold subject to the outstanding ad valorem taxes and/or assessments, if any.
