GB6-41613 Worrells NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT STATE OF GEORGIA COUNTY OF HARALSON BY VIRTUE OF THE POWER OF SALE contained in the Deed to Secure Debt given by Jimmie M. Worrells to Douglas County Bank, dated October 31, 2008, and recorded November 4, 2008 in Deed Book 966, Page 108, Haralson County Georgia records, said Deed to Secure Debt being given to secure a loan note dated October 31, 2008, in the original principal amount of $91,000.00, last modified at Deed Book 1073, Page 270, transferred and assigned to Hamilton State Bank, a Georgia banking corporation and assignee of the Federal Deposit Insurance Corporation (FDIC) as Receiver for Douglas County Bank (former bank) pursuant to that certain Purchase and Assumption Agreement dated April 26, 2013, there will be sold at public outcry for cash to the highest bidder before the Courthouse door of Haralson County, Georgia, between the legal hours of sale on the first Tuesday in July, 2016, by Hamilton State Bank, as attorney-in-fact for Jimmie M. Worrells, the following described property: Tract I All that tract or parcel of land lying and being in Land Lot 162 of the 7th District, 5th Section of Haralson County, Georgia, containing 10.00 acres, more or less, shown on Tract A on a plat prepared for Hubert Shedd by Gilbert O. Maulsby, Jr., RLS #1555, dated December 13, 1981, and recorded in Plat Book 11, Page 131, in the Office of the Clerk of Superior Court of Haralson County, Georgia. Said plat together with the boundaries, metes, courses and distances thereon are incorporated herein and by reference are made a part of this description as fully as if set out herein. Tract II All that tract or parcel of land lying and being in Land Lot 162 of the 7th District, 5th Section of Haralson County, Georgia, which is more particularly described as follows to wit: To find the point of beginning, commence at the intersection of the north right of way of Old Hamilton Mill Road and the West land lot line of Land Lot 162; thence easterly, along said north right of way, a distance of 1236.77 feet to an iron pin; thence north 58 degrees 51 minutes 36 seconds east a distance of 104.80 feet to an iron pin; thence continue easterly along said north right of way, a distance of 104.80 feet to an iron pin; thence continue easterly along said north right of way, a distance of 150 feet, more or less, but specifically to an iron pin; thence north 70 degrees 14 minutes 53 seconds east a distance of 48.16 feet to an iron pin and the Point of Beginning. From said point of beginning and leaving said north right of way north 02 degrees 51 minutes 41 seconds west a distance of 195.40 feet to an iron pin; thence north 78 degrees 27 minutes 58 seconds east a distance of 229.01 feet to an iron pin; thence south 01 degrees 46 minutes 14 seconds west a distance of 195.40 feet to an iron pin on the aforesaid north right of way; thence westerly along said right of way, a distance of 230 feet, more or less, but specifically to the Point of Beginning. The above description is made in accordance with a plat prepared for Hubert Shedd by Gilbert Maulsby, Jr. RLS #1150, dated December 13, 1981, and recorded in Haralson County Plat Book 11, Page 131, which said plat is incorporated herein by reference. The debt secured by said Deed to Secure Debt has been and is hereby declared due and payable because of non-payment of monthly installments on said loan note. Said property will be sold subject to the following encumbrances. (1) Outstanding ad valorem taxes and/or assessments, if any, and all prior encumbrances of record.
