Legal 149 Notice  Of  Sale  Under  Power State Of Georgia, County Of Pike Notice is hereby given that pursuant to the power of sale contained in a Deed to Secure Debt executed and delivered on January 8, 2011, by Toby Selph, as Grantor, to First Bank of Pike, as Grantee, and recorded in Deed Book 849, Page 85, Pike County Superior Court records, which said Deed to Secure Debt was transferred and assigned to Charlotte T. Bennett by document dated October 30, 2015 and recorded at Deed Book 1014, Page 276, said records, and by virtue of default in payment in indebtedness therein mentioned, which has made the aforesaid power of sale operative and effective, the undersigned, Charlotte T. Bennett, as Attorney‑in‑fact for Toby Selph will sell at public outcry before the Courthouse door in Pike County, Georgia, on July 5, 2016, during the legal hours of sale, to the highest bidder for cash, the property described in said Security Deed to‑wit: All that tract or parcel of land containing 10.0 acres, more or less, lying and being in Landlots 181 & 204 of the 8th Land District of Pike County, Georgia, and being more particularly shown and designated as 10.0 AC. According to that certain plat of survey entitled, “Property Survey for Tom Barrett & Associates, Inc.”, Registered Professional Land Surveyor, a copy of which said plat is recorded in Plat Book 4, Page 87, Clerk's Office, Superior Court, Pike County, Georgia, and which said plat, together with the metes, bounds, courses and distances as shown thereon wih respect to the said 10.0 acres, is by this reference incorporated herein in aid of this description as fully as if copied at length herein. LESS AND EXCEPT: All that tract or parcel of land containing 7.034 acres, more or less, lying and being in Landlots 181 & 204 of the 8th Land District of Pike County, Georgia, and being more particularly shown and designated as 7.034 acres according to that certain plat of survey entitled “Property Survey for Emmitt V. Yeoman, Jr. & Clara Ann Dean Yeoman”, dated April 3, 1997, prepared by Gerald H. Bernhard, Georgia Registered Professional Land Surveyor, a copy of which said plat is recorded in Plat Book 14 , Page 61, Clerk's Office, Superior Court, Pike County, Georgia, and which said plat, together with the metes, bounds, courses and distances as shown thereon with respect to the said 7.034 acres, is by this reference incorporated herein in aid of this description as fully as if copied at length herein. The net acreage of the subject property is 2.966 acres. Notice of the initiation of proceedings to exercise the power of sale in the Deed to Secure Debt hereinabove referenced has been given and of Grantee's intention to collect attorney's fees in connection herewith as required by law. The note executed on October 30, 2015, by Toby Selph, as Grantor, to First Bank of Pike, as Grantee, and secured by said Deed to Secure Debt and assignments, is now in default and the said Charlotte T. Bennett, does so elect that said indebtedness, with principal and interest, become due and payable at once. The said property shall be sold subject to all outstand-ing taxes and assessments against said property. The proceeds from said sale shall be distributed as follows: (1) to pay the expense of said sale; (2) to pay all indebtedness secured by said Deed to Secure Debt; (3) to pay attorney's fees; and (4) to distribute any excess proceeds as provided by law.
