NOTICE OF SALE STATE OF GEORGIA COUNTY OF LIBERTY WHEREAS, there has been a default in the payment of the indebtedness secured by that certain Deed to Secure Debt dated February 3, 2015, executed by CIRCLE M. CONSTRUCTION, INC.., of Liberty County, Georgia, and by Jerry D. McCumber, Individually as Guarantor in the original principal amount of Two Hundred Thirteen Thousand Eight Hundred Twenty Four and 00/100 ($213,824.00) Dollars, recorded in Deed Book 1851, Pages 879-883, in the Office of the Clerk of Superior Court of Liberty County, Georgia. WHEREAS, under the provisions of the said Deed to Secure Debt said indebtedness secured thereby has immediately become due and payable and remains in default. NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That pursuant to the terms of the original Deed to Secure Debt and the power of sale contained therein and the laws in such cases made and provided, after proper advertisement, the undersigned, on the First Tuesday in June, to wit: June 7, 2016, before the Courthouse door in Liberty County, Georgia, between the legal hours of sale, will expose for sale to the highest and best bidder for cash the following described property, to-wit: All that certain t tract, lot or parcel of land, situate, lying and being in the 1476th G. M. District of Liberty County, Georgia, being known and designated as Lot 58, Phase I, The Colonies at Habersham Plantation. Said lot is more definitely and accurately depicted on that certain plat of survey made and prepared by T. R. Long Engineering, P. C., dated November 29, 2012 , and recorded in the office of the Clerk of the Superior Court of Liberty County, Georgia, in Plat Cabinet P-53, Pages 1A-D, reference being hereby made thereto for descriptive and for all other purposes. The above property is subject to Restrictive Covenants as to The Colonies at Habersham Plantation, dated December 30, 2013, and recorded in Deed Book 1765, Page 724, Liberty County Public Records Said sale of property will be made for the purpose of paying the indebtedness, which said deed was given to secure, and the proceeds will be applied as provided therein. A deed will be executed to the purchaser by the undersigned under the provisions of said deed to secure debt. Purchaser shall pay title, transfer tax and ad valorem taxes on said property.
