By virtue of the power of sale contained in that certain Security Deed (as modified, hereinafter the “Security Deedâ€) from Jason Terrell to First Georgia Banking Company (with RREF II CER-A-GA, LLC as assignee of RREF II CER Acquisitions, LLC (“RREFâ€), as assignee of Certusbank, N.A. (“Certusâ€), as assignee of the Federal Deposit Insurance Corporation (“FDICâ€), as receiver for First Georgia Banking Company (“FGBCâ€)), dated November 13, 2008, recorded at Deed Book 53R, Page 508, Jackson County, Georgia records, as modified by that certain Modification Agreement, dated November 24, 2009, and recorded at Deed Book 56T, Page 372, aforesaid records, and as further modified by that certain Modification of Deed to Secure Debt, dated June 12, 2012, and recorded at Deed Book 63O, Page 455, aforesaid records; said Security Deed being given to secure indebtedness under that certain Promissory Note (as renewed, hereinafter the “Noteâ€) from Jason Terrell to FGBC (with RREF II CER-A-GA, LLC as assignee of RREF, as assignee of Certus, as assignee of FDIC, as receiver for FGBC), dated November 13, 2008 and last renewed on June 12, 2012, in the last renewed principal amount of SIXTY SIX THOUSAND EIGHT HUNDRED FIFTY EIGHT AND 23/100 DOLLARS ($66,858.23), with interest on the unpaid balance from the date thereof until maturity or until paid, together with all other amounts payable with respect thereto; there will be sold by the undersigned at public outcry to the highest bidder, for cash before the Courthouse door in Jefferson, Jackson County, Georgia, within the legal hours of sale on the first Tuesday in June, 2016, the property being more fully described as follows:
All that tract or parcel of land lying and being in the City of Commerce, 255th GMD of Jackson County, Georgia, and being Lot 19, Block A of Deer Creek Subdivision, as per plat of the subdivision recorded in Plat Book 57, Page 251, Jackson County, Georgia Records, said plat being incorporated herein by reference and made a part of this description.
The debt secured by said Note and Security Deed has been and is hereby declared due and payable in full because of, among other possible events of default, non payment of principal and interest owed in accordance with the terms of the Note and the Security Deed. The indebtedness remaining in default, this sale will be made for purposes of paying the same and all expenses of this sale, including attorney's fees.
To the best knowledge and belief of the undersigned, the subject property is in the possession of Jason Terrell or parties claiming by, through or under Jason Terrell.
Said property will be sold as the property of Jason Terrell on an “as is, where is†basis, without recourse and without representation or warranty, express or implied, of any nature whatsoever with respect thereto and will be sold subject to all unpaid taxes, assessments, and any superior items of record, as well as any matters as would be revealed by an accurate survey and inspection of the subject property.
