NOTICE OF SALE UNDER POWER STATE OF GEORGIA, HART COUNTY By virtue of Power of Sale contained in a Deed to Secure Debt from Joanne H. Petruska to Marvin L. Parsons dated May 17, 2004, recorded in Deed Book 487, Pages 279-282, in the office of the Clerk of Superior Court of Hart County, Georgia, and said Deed to Secure Debt being given to secure a Note dated May 17, 2004 in the original principal amount of Twenty Nine Thousand Five Hundred and 00/100------------- ($29,500.00) dollars, with interest from date as stated therein; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Hart County, Georgia, within the legal hours of sale on the first Tuesday in July, 2016, the following described property: All that tract or parcel of land, together with all improvements thereon, situate, lying and being in the 1115th G.M. District of Hart County, Georgia, containing 6.14 acres, more or less, and being known and designated as Tract "B" on a plat by Dean H. Teasley, Surveyor, dated April 30, 2004, recorded at Plat Book 33, Page 232, in the Office of the Clerk of Superior Court of Hart County, which said plat is hereby incorporated into this description by reference and made a part hereof, and being a portion of the property conveyed to Marvin L. Parsons and William Paul Gandee by Faire T. Teasley and Terry O. Agnew by Warranty Deed dated August 29, 2002, recorded at Deed Book 422, Page 472, in the Office of the Clerk of Superior Court of Hart County, Georgia. To the best of the knowledge and belief of the undersigned, the party in possession of the property is Joanne H. Petruska or a tenant or tenants. Said property is more commonly known as: 5145 Reed Creek Hwy., Hartwell, Georgia 30643. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the installment on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees (notice of Attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes, special assessments, unpaid utility bills constituting liens against the property, and all Security deeds, Deeds to Secure Debt, liens and encumbrances existing and filed for record when the above described Deed to Secure Debt was filed for record. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final information and audit of the status of the loan with the holder of the Deed to Secure Debt. Pursuant to O.C.G.A. Section 9-13-172.1, which allows for certain procedures regarding the rescission of the judicial and nonjudicial sales in the State of Georgia, the Deed under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided in the preceding paragraph. To the best of the undersigned's knowledge, information and belief, equitable title to this property is held by Joanne H. Petruska and will be sold as the property of Joanne H. Petruska.
