NOTICE OF SALE UNDER POWER GEORGIA, GLYNN COUNTY Under authority of the powers of sale and conveyance contained in that certain Deed to Secure Debt given by HERITAGE HOUSING OUTLET, LLC to LUDOWICI BANK, a Division of Glennville Bank, dated April 28, 2015, the same being recorded in Deed Book 3429, Pages 201-207, Glynn County Records, conveying the after-described property to secure a Note dated April 28, 2015, executed by HERITAGE HOUSING OUTLET, LLC, in the original principal amount of ONE HUNDRED SIXTY-FIVE THOUSAND FOUR HUNDRED SIXTY-FOUR AND 00/100 DOLLARS ($165,464.00), with interest thereon as set forth therein, there will be sold on the first Tuesday in June, 2016, within the legal hours of sale, before the Courthouse door in Brunswick, Glynn County, Georgia, at public outcry to the highest bidder for cash, the land conveyed in said security deed described as follows: All of that certain lot, tract or parcel of land situate, lying and being on the Island of St. Simons, in Glynn County, Georgia, which is described and identified according to a plat of survey by Ernest D. Johns, Jr., Georgia Registered Surveyor No. 2774, dated April 4, 2005, entitled "Mabry Subdivision, a Minor Subdivision of 3.904 Acres", which is recorded in the office of the Clerk of Superior Court of Glynn County, Georgia, at Plat Cabinet No. 1, Map No. 109-B, as all of Lot Number 2, which lot is described according to said plat as follows: to locate the beginning point commence at an iron pin located at the point of intersection of the easterly right-of-way line of Demere Road with the southern right-of-way line of Yucca Lane and from said point running thence along said Demere Road right-of-way south 03 degrees 07 minutes 52 seconds west for a distance of 79.86 feet to a found iron pin; thence running along the northerly boundary of Lot 1 south 84 degrees 07 minutes 10 seconds east for a distance of 109.22 feet to the set iron pin which marks the point and place of beginning of Lot 2, as herein described, which contains 18,236 square feet, according to said plat; from said beginning point thence running along the northerly boundary of Lot 2 south 84 degrees 07 minutes 10 seconds east for a distance of 105.00 feet to a set iron pin; thence running along the boundary between Lot 2, as hereby described, and Lot 3 south 05 degrees 52 minutes 50 seconds west for a distance of 174.66 feet to a set iron pin; thence running along the southerly boundary of Lot 2 north 83 degrees 59 minutes 22 seconds west for a distance of 105.00 feet to a set iron pin; thence running north 05 degrees 52 minutes 50 seconds west along the boundary between Lot Number 2, as herein described, and Lot Number 1 for a distance of 174.42 feet to the set iron pin which marks the point and place of beginning of Lot Number 2, as herein described. Also conveyed hereby is the right to the use and benefit of the 20-foot drainage easement and the 60-foot non-exclusive right-of-way easement for purposes of ingress and egress between the lot herein described and conveyed and Demere Road described below, provided, however, that the right to use said easement for ingress and egress conveyed hereby does not extend any further east than the boundary line between Lots Number 2 and 3, as shown on said plat, and will not confer any right to the second parties herein to go across said boundary line into Lot 3. Subject, however, to a 20-foot drainage easement and a non-exclusive 60-foot right-of-way easement for purposes of vehicular and pedestrian ingress and egress to and from Demere Road to the three lots described on the aforesaid plat, the portion of said Lot Number 2, which is occupied by said drainage easement and right-of-way easement being described according to said plat as follows: beginning at the point of beginning of Lot Number 2, as hereinabove described, and from said point running thence along the northerly boundary of Lot 2 south 84 degrees 07 minutes 10 seconds east for a distance of 105.00 feet to a set iron pin; thence running south 05 degrees 52 minutes 50 seconds west for a distance of 60.00 feet along the boundary between Lots Number 2 and 3 to a set iron pin; thence running north 84degrees 07 minutes 10 seconds west for a distance of 105.00 feet to a set iron pin located on the boundary between Lots Number 1 and 2; thence running along said boundary line north 05 degrees 52 minutes 50 seconds west for a distance of 60.00 feet to the set iron pin which arks the point and place of beginning of the portion of said lot occupied by said drainage easement and right-of-way easement. Parcel ID - 04-06446 The indebtedness secured by said Deed to Secure Debt has become in default as to principal and interest because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed and the whole amount of said indebtedness is declared to be in default and immediately due and payable, and the above-described property will be sold for the purpose of enforcing payment of the indebtedness secured by said Deed to Secure Debt. A deed will be executed to the purchaser at said sale conveying title as authorized in said Deed to Secure Debt. The proceeds of said sale will first be applied to the payment of the indebtedness to Ludowici Bank, other charges and the expenses of sale as provided in said Deed to Secure Debt including attorney's fees (notice of intent to collect attorney's fees having been given) and the excess, if any, as provided by law. Said sale and the deed made to the purchaser at said sale will be subject to any outstanding unpaid ad valorem taxes on said property (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
