STATE OF GEORGIA COUNTY OF GLYNN NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by Eugene Frederick Griffith III to Mortgage Electronic Registration Systems, Inc. as nominee for PHH Mortgage Services, and its successors and assigns dated July 7, 2006, and recorded in Deed Book 1994, Page 85, and Deed Book 2534, Page 24Deed Book 2838, Page 320Deed Book 3388, Page 494, Glynn County Records, said Security Deed having been last sold, assigned, transferred and conveyed to USBank N.A. as successor trustee for Bank of America Merrill Lynch as successor trustee for LaSalle Bank N.A. for the LXS 2006-15 trust by Assignment, securing a Note in the original principal amount of $171,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, July 5, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All of that certain lot, tract or parcel of land situate, lying and being on St. Simons Island, in Glynn County, Georgia, described and identified according to the map of Glynn Haven Estates Subdivision recorded in the office of the Clerk of Superior Court, Glynn County, Georgia as the EASTERN 7.65 FEET OF LOT NUMBERED FOUR (4), AND ALL OF LOTS NUMBERED FIVE (5), SIX (6), SEVEN (7) AND EIGHT (8), BLOCK 21, GLYNN HAVEN ESTATES SUBDIVISION, GLYNN COUNTY, GEORGIA. Said properly being more particularly described according to the plat of survey of Joe Biletzskov, Georgia Registered Land Surveyor No 1672, dated June 29, 1988, and recorded in the aforesaid records in Deed Book 30-Y, Page 492.?Reference is hereby made to aforesaid plat and to the record thereof for the purpose of more particularly describing and identifying the location, metes and bounds of the subject property and for all other purposes allowed by law Said property is known as 410 Palmetto Street, Saint Simons Island, GA 31522, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
