STATE OF GEORGIA COUNTY OF GLYNN NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by James D. Anderson and Linda K. Anderson to Mortgage Electronic Registration Systems, Inc. as nominee for Taylor, Bean and Whitaker Mortgage Corp. and its successors and assigns dated June 6, 2007, and recorded in Deed Book 2250, Page 71, Glynn County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Selene Finance LP by Assignment, securing a Note in the original principal amount of $149,459.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, July 5, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All that tract or parcel of land lying and being In GLYNN County, Georgia, and in that subdivision therein known as Glyndale Subdivision, described and identified as per the map and plat of said subdivision prepared by James L. Conine, R.L.S. No. 1545, dated December 31, 1970, and being a portion of Lot 48, Section D, Addition 2, Glyndale Subdivision, Reference is hereby made to said map and plat of survey for all purposes of description, location, metes and bounds and for all other purposes allowed by law.?The above described parcel being intended to be that same parcel of land acquired by James L. Gandy and Cortie W. Gandy 2-1-1971 at Deed Book 15-W, Page 725. All that lot, tract or parcel of land situate, lying and being in the 1356th GM District, Glynn County, Georgia, and being more particularly described as Lot 49, Glyndale Subdivision, Section D, Addition 2, as shown by that certain plat of survey prepared by Atwood M. Freeman, GRS dated February 14, 1953 and recorded in Plat Drawer 5, Page 127, Glynn County Public Land Records; said plat by this reference being incorporated herein for descriptive and all other purposes. There is excepted from the above-described property all the property conveyed to the State Highway Department of Georgia and being recorded in Deed Book 14-J, Page 581, aforesaid public records. Said property is known as 174 Glyndale Cir., Brunswick, GA 31520, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
