NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF FANNIN By virtue of a Power of Sale contained in that certain Security Deed from Thomas E. Bryant and Joyce D. Bryant to Copper Basin Federal Credit Union, dated August 31, 2007, filed September 11, 2007, recorded in Deed Book 809, Page 194-208, Fannin County, Georgia records, as may have been modified and/or renewed from time to time, (hereinafter the Security Deed), the Security Deed being given to secure a Note of even date between Thomas E. Bryant and Joyce D. Bryant (borrower) and Copper Basin Federal Credit Union (lender), in the original principal amount of Thirty-One Thousand Five Hundred Sixteen and 75/100 Dollars ($31,516.75), as may have been modified/renewed from time to time, (hereinafter Note), with interest thereon as provided therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Fannin County, Georgia, within the legal hours of sale on the first Tuesday in June, 2016, the following described property: All that tract or parcel of land lying and being in the 7th District and 1st Section of Fannin County, Georgia, being part of Land Lot No. 276, and being designated as Lot No. 3, of Rock Creek Development, containing 1.00 acre of land as shown on plat of survey dated January 24, 1990, prepared by Lane S. Bishop, G.R. L.S. No. 1575, and being recorded in Plat Book 24, Page 28, Fannin County Deed Records. Said plat of survey is incorporated herein by reference for a more complete and accurate description of the above described property. Being and intended to be the same property conveyed by Warranty Deed dated January 17, 2005, from Fernando Millan and Nydia T. Millan in favor of Thomas Dean Bryant and Joyce D. Bryant and recorded in Fannin County Records in Deed Book 616, Page 814; corrected by Corrective Warranty Deed dated June 6, 2005, from Fernando Millan and Nydia T. Millan in favor of Thomas E. Bryant and Joyce D. Bryant and recorded in Fannin County Records in Deed Book 656, Page 619. The above described property is conveyed subject to Declaration of Restrictive Covenants recorded in Deed Book 159, Page 472, Fannin County Deed Records. The above described property is conveyed subject to all easements, restrictions and rights of way as shown on plat recorded in Plat Hanger A-40, Pages 5-7, Fannin County Deed Records. To have and to hold the said bargained premises together with all improvements now situated or hereafter placed thereon, and all interest, right and equity which the party of the first part now or may hereafter have therein to the only proper use, benefit, and behoof of the said party of the second part, its successors, heirs and assigns forever, in fee simple. The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purposes of paying the same and all expenses of sale, as provided in the Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien on the property but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed.
