CLASS:007 NOTICE OF SALE UNDER POWER On the 22nd day of August, 2013, Clark Cleveland and Marian Cleveland executed and delivered a Deed to Secure Debt and Security Agreement for the principal sum of SIX THOUSAND AND 00/100s DOLLARS ($6,000.00) to WIlLIAM B. JONES d/b/a JONES REAL ESTATE, P.O. Box 933, Jackson, Georgia 30233. Said Deed to Secure Debt and Security Agreement is recorded in Deed Book 4006, Page 139, in the Office of the Clerk of Superior Court, Coweta County, Georgia. Time was the essence of the contract, and said Note contained a provision for payment of fifteen percent (15%) of the unpaid principal and interest as attorneys' fees if the claim be placed in the hands of an attorney for collection. In order to secure the payment of said Note, the Deed to Secure Debt and Security Agreement conveyed the following interest in real estate, to-wit: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN THE CITY OFNEWNAN, COWETY COUNTY, GEORGIA IN LAND LOT 27 OF THE FIFTH LAND DISTRICT; AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: LOT 12 OF BLOCK 9 OF THE WESTSIDE PROJECT NO. 1, CITY OF NEWNAN, GEORGIA (WESTSIDE URBAN RENEWAL PROJECT, GA. R- 117), PER PLAT BY MILLER, STEVENSON & STEINICHEN, INC., RECORDED IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF COWETA COUNTY, GEORGIA, IN PLAT BOOK 22, PAGE 139, REFERENCE TO WHICH IS HEREBY MADE FOR A MORE EXACT DESCRIPTION. Because of a default in making payments as they matured, Jones Real Estate, pursuant to the provisions of said Deed to Secure Debt and Security Agreement, securing the same, has exercised its option and declared the entire balance due and collectible. Notice fixing the liability for attorneys' fees has been given according to law. Said Deed to Secure Debt and Security Agreement contains a power of sale authorizing the Grantee to sell the property described above in order to satisfy said Deed to Secure Debt and Security Agreement, as well as subsequent advances, after advertising the same once a week for four (4) weeks in the official gazette of said County. In accordance with said Power of Sale and by virtue thereon, Jones Real Estate will sell the property described above at public outcry to the highest bidder for cash, on July 5, 2016, before the Coweta County Courthouse door, the place of public sales in Newnan, Coweta County, Georgia, and within and during the legal hours of sale. The proceeds of the sale will be used as follows: (1) To pay the expense of said sale; (2) To pay the sums secured by said Security Deed; (3) The balance, if any, to the appropriate parties.
