STATE OF GEORGIA COUNTY OF COLUMBIA NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in that certain security deed, given by KIMBERLY ANN ADAMS, dated February 27, 2015, filed March 3, 2015, of record in the Office of the Clerk, Superior Court, Columbia County, Georgia, in Deed Book 9729, Pages 140-143, conveying the hereinafter described property to secure a note in the principle amount of $221,800.00, with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the Courthouse door in Columbia County, Georgia, within the legal hours of sale on the first Tuesday in June 2016, the following described property, to-wit: ALL that lot, tract or parcel of land lying and being situated in the 128th District G.M., Columbia County, Georgia, which said lot, tract or parcel of land contains 4.849 acres, and being bounded, now of formerly, as follows: On the North by lands of Byrd, on the East by Byrd Road, on the South by lands of Floyd Payne, Jr., evidenced by a Plat of Survey dated January 30, 1986, and having been recorded in PC "A", Slide 156#4, of the Columbia County Superior Court Clerk's Office, and on the South and West by lands of Golden Ventures, Inc., on January 16, 1984, a copy of which is of record in the Office of the Clerk of the Superior court of Columbia County, Georgia in Plat Book 13, Page 208 which reflects the metes, bounds and dimensions of the herein referenced lot, tract or parcel of land; reference is hereby made to said plat for a more complete and accurate description as to the metes, bounds and location of said property hereby conveyed. ALSO conveyed herein is one 1986 Horton Summit mobile home, VIN#H445202GLR. This property is known as Map 042, Parcel 356 (688 Byrd Drive) according to the present tax mapping system of the Columbia County Tax Assessors' Office. The debt secured by said security deed instrument has been and is hereby declared due because, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the note and security deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of said sale, as provided in the security deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by a current and accurate survey and inspection of the property, any assessments, lien, encumbrances, zoning ordinances, restrictions, covenants, and any and all other matters of record superior to the security deed first hereinabove set out, if any. To the best knowledge and belief of the undersigned, the party in possession of the property is KIMBERLY ANN ADAMS and said property is more commonly known as 688 Byrd Drive, Harlem, Georgia 30814. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed..
