NOTICE OF SALE UNDER POWER, Ben Hill County Pursuant to the Power of Sale contained in a Security Deed given by John B Rowell, III to Southern Cresent Mortgage & Investment Corp. dated 6/2/2000 and recorded in Deed Book 457 Page 130 Ben Hill County, Georgia records; as last transferred to or acquired by JPMorgan Chase Bank, National Association s/b/m Chase Home Finance, LLC s/b/m Chase Manhattan Mortgage Corporation, conveying the after-described property to secure a Note in the original principal amount of $ 58,000.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Ben Hill County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on July 05, 2016 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property: All of Lot Number Thirty-five (35) in Block E in Turner Heights Subdivision Addition in the City of Fitzgerald, Ben Hill County, Georgia, as shown by the plat of said Subdivision prepared by S. Y. A. Ball, Georgia Registered Land Surveyor, and recorded in Plat Book 5, page 49 [now Plat Slide Number 495], in the office of the Clerk of the Superior Court of Ben Hill County, Georgia, and being more particularly described as follows: To find the point of beginning commence at the intersection of the south right of way line of Washington Avenue with the east right of way line of Traylor Avenue, thence South 01 degree 30 minutes 00 seconds west 230.00 to a point, and which point is the Point of Beginning of the property described herein, and from said Point of Beginning thence North 88 degrees 30 minutes 00 seconds east 125.00 feet to a point; thence South 01 degree 30 minutes 00 seconds east 115.00 feet along the west right of way line of a twenty foot graded alley to a point; thence South 88 degrees 30 minutes 00 seconds west 125.00 feet to a point; thence North 01 degree 30 minutes 00 seconds west 115.00 feet along the east right of way line of Traylor Avenue to the Point of Beginning, as shown by that certain plat of survey prepared by James D. Weeks, Georgia Reg-istered Land Surveyor, dated December 23, 1992, and recorded in Plat Slide Number 365 [now Plat Slide Number 602], in said Clerk's office, and said plat by reference thereto is hereby made a part of this description. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property is commonly known as 133 Traylor Avenue, , Fitzgerald, GA 31750 together with all fixtures and personal property attached to and constituting a part of said property, if any. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is (are): John B Rowell, III or tenant or tenants. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
