PROPERTY MANAGEMENT, INC., to COMMERCIAL BANK dated December 28, 2004, and recorded on January 11, 2005, in DEED BOOK 848, PAGE 340, of the COLQUITT County, Georgia Records; as last assigned to SRP 2009-3, LLC, by Assignment dated OCTOBER 1, 2014, and recorded on APRIL 4, 2016, recorded at DEED BOOK 1264, PAGE 58, aforesaid records; conveying the after-described property to secure a Note in the original principal amount of THIRTY THREE THOUSAND, THREE HUNDRED EIGHTY SEVEN Dollars and 00/100 ($33,387.00) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of COLQUITT County, Georgia, within the legal hours of sale on the first TUESDAY in JUNE 2016, the following described property: ALL THAT CERTAIN PIECE, PARCEL OR TRACT OF LAND SITUATE, LYING AND BEING IN THE ORIGINAL LOT OF LAND NO. 244, IN THE 8TH LAND DISTRICT OF COLQUITT COUNTY, GEORGIA, AND DESIGNATED AS LOT 9, IN BLOCK 1, OF NORTHSIDE TERRACE SUBDIVISION PREPARED BY HURLEY J. GRIFFIN, SURVEYOR, OF DATE OF OCTOBER 12, 1970, REVISED AND AUGUST 18, 1971, AND SEPTEMBER 15, 1972, AND RECORDED IN PLAT BOOK 6, PAGE 60, IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF COLQUITT COUNTY, GEORGIA, WHICH SAID PLAT AND THE RECORD THEREOF ARE BY REFERENCE INCORPORATED HEREIN. The indebtedness secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, non-payment of the monthly installments as required by said Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorneys fees having been given) and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
