STATE OF GEORGIA COUNTY OF GLYNN NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in that certain Security Deed (as modified, hereinafter the "Security Deed") from H Cubed Incorporated to Sapelo National Bank (with RREF II CER-A-GA, LLC, as assignee of RREF II CER Acquisitions, LLC, as assignee of Certusbank, N.A., as successor in interest to Sapelo National Bank, a division of Atlantic Southern Bank), dated October 13, 2006, recorded at Deed Book 2072, Page 118, Glynn County, Georgia records, as modified by that certain Modification of Deed to Secure Debt, dated April 13, 2008, and recorded at Deed Book 2449, Page 259, aforesaid records; said Security Deed being given to secure indebtedness under that certain Promissory Note (as renewed, hereinafter the "Note") from H Cubed Incorporated to Sapelo National Bank (with RREF II CER-A-GA, LLC, as assignee of RREF II CER Acquisitions, LLC, as assignee of Certusbank, N.A., as successor in interest to Sapelo National Bank, a division of Atlantic Southern Bank), dated October 13, 2006 and last renewed on January 24, 2011, in the last renewed principal amount of THREE HUNDRED THIRTY FOUR THOUSAND SIX HUNDRED SIXTY THREE AND 63/100 DOLLARS ($334,663.63), with interest on the unpaid balance from the date thereof until maturity or until paid, together with all other amounts payable with respect thereto; there will be sold by the undersigned at public outcry to the highest bidder, for cash before the Courthouse door in Brunswick, Glynn County, Georgia, within the legal hours of sale on the first Tuesday in June, 2016, the property being more fully described as follows: All that certain lot, tract or parcel of land, situate, lying and being in Glynn County, Georgia, and in the 27th District G.M., therein, known and described according to the map and plan of Laurel Grove Plantation, Phase IV, dated April 18, 2000, and made by James L. Conine, Georgia Registered Surveyor Number 1545, known and described according to said plat as LOT NUMBER FOURTEEN (14), BLOCK "E", OF LAUREL GROVE PLANTATION SUBDIVISION, PHASE IV. The aforesaid map and plat being recorded in Plat Drawer 26, as Document Number 123, in the Office of the Clerk of Superior Court of Glynn County, Georgia, and referred to herein for all further purposes of description. Being the same property conveyed to H Cubed Incorporated by Pete Robison and Barbara Robison by Warranty Deed dated September 21, 2005 and recorded September 26, 2005 in Book 1776, page 97. The debt secured by said Note and Security Deed has been and is hereby declared due and payable in full because of, among other possible events of default, non payment of principal and interest owed in accordance with the terms of the Note and the Security Deed. The indebtedness remaining in default, this sale will be made for purposes of paying the same and all expenses of this sale, including attorney's fees. To the best knowledge and belief of the undersigned, the subject property is in the possession of H Cubed Incorporated or parties claiming by, through or under H Cubed Incorporated. Said property will be sold as the property of H Cubed Incorporated on an "as is, where is" basis, without recourse and without representation or warranty, express or implied, of any nature whatsoever with respect thereto and will be sold subject to all unpaid taxes, assessments, and any superior items of record, as well as any matters as would be revealed by an accurate survey and inspection of the subject property.
