CLASS:007 NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF COWETA Because of a default in the payment of the indebtedness secured by a Security Deed executed by Larry McKenzie, Jr, aka JR McKenzie to TNK Properties, LLC dated September 10, 2014, and recorded in Deed Book 4131, Page 578-583, Coweta County Records, securing a Note dated September 10, 2014 in the original principal amount of $32,938.27, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said Deed, will on the first Tuesday, June 7, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to wit: TRACT ONE: All that certain tract or parcel of land lying and being in Land Lot 66 of the 5th Land District of Coweta County, Georgia and more particularly described as being Lot 58, Block D, as shown by plat of the Meadowview Subdivision Addition recorded in Plat Book 18, Page 297, Coweta County, Georgia Records, reference to which plat is hereby made for a more particular description of the property herein conveyed. (Property known as 77 Shellnut Way) TRACT TWO: All that certain tract or parcel of land lying and being in Land Lot 66 of the Fifth Land District of Coweta County, Georgia and known and designated as Lot No. 7, Block C of Meadowview Subdivision as shown by plat by T.Y. Mattox, Registered Land Surveyor, dated May, 1970, and recorded in Plat Book 14, Page 35, in the Office of the Clerk of the Superior Court of Coweta County, Georgia to which plat reference is hereby made for a more particular description of the lot herein conveyed. (Included is a mobile home, Model Jamison, Manufacturer's I.D. 72JG1660. (Property known as 119 Meadowview Lane) TRACT THREE: All that tract or parcel of land situate and being in the City of Newnan, Coweta County, Georgia known and distinguished as No. 5 Mary Ann Street, in the City of Newnan, Georgia according to the system of numbering houses presently in force in said city and being more particularly described as follows: Beginning at the intersection made by the South side of Mary Ann Street and a line drawn perpendicular to the South side of Mary Ann Street and running South 3 feet East of the northeast corner of Grantors carport and from the beginning point thus determined; run thence East along the South side of Mary Ann Street 80 feet, more or less, to the center of common drive; thence South along the center line of said drive and property of Castina Sinkfield 100 feet; thence West parallel to Mary Ann Street 80 feet to a point 100 feet South of Mary Ann Street and on a line drawn perpendicular to Mary Ann Street at the beginning point; thence North along a line perpendicular to Mary Ann Street 100 feet to the beginning point. This deed is given subject to rights of others use of joint driveway on the East side of the property as a means of ingress and egress. (Property known as 5 Mary Ann Street) Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed. Notice has been given of intention to collect attorney's fees in accordance with the terms of the Note secured by said Deed. Said property will be sold as the property of Larry McKenzie, Jr, aka JR McKenzie, the property, to the best information, knowledge and belief of the undersigned, being presently in the possession of Larry McKenzie, Jr, aka JR McKenzie or a tenant or tenants, and the proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale, including attorney's fees, all as provided in said Deed, and the balance, if any, will be distributed as provided by law.
