NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF GWINNETT Under and by virtue of the power of sale contained with that certain Security Deed dated December 5, 2003, from Mark Dees and Claire Dees to Washington Mutual Bank, FA, a Federal Association, recorded on December 19, 2003 in Deed Book 36423 at Page 00033, Gwinnett County, Georgia Records, having been last sold, assigned, transferred and conveyed to U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust by Assignment and said Security Deed having been given to secure a note dated December 5, 2003, in the amount of $120,000.00, said note being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Gwinnett County, Georgia, on June 7, 2016, the following described real property (hereinafter referred to as the Property): ALL THAT TRACT OF LAND LYING AND BEING IN LAND LOT 229 OF THE 6TH DISTRICT OF GWINNETT COUNTY, GEORGIA BEING LOT 5, BLOCK A, UNIT ONE, TATURN RIDGE, AS PER PLAT RECORDED IN PLAT BOOK 14, PAGE 35, GWINNETT COUNTY, GEORGIA RECORDS, WHICH PLAT IS HEREBY REFERRED TO AND MADE A PART OF THIS DESCRIPTION; BEING IMPROVED PROPERTY KNOWN AS 4256 NORA LANE, ACCORDING TO THE MOST RECENT SYSTEM OF NUMBERING HOUSES IN SAID COUNTY. The debt secured by the Security Deed and evidenced by the Note and has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Security Deed, accrued interest, and all expenses of the sale, including attorneys fees. Taplin; B. Taplin; and Alan Cook. The property, being commonly known as 4256 Nora Lane, Duluth, GA, 30096 in Gwinnett County, will be sold as the property of Mark Dees and Claire Dees; S. Wood, as Trustee of the Nora Trust A; S. Wood, as Trustee of the Nora Trust B; S. Wood, as Trustee of the Nora Trust C; S. Wood, as Trustee of the Gwinnett NC45D Trust; S. Wood, as Trustee of the Gwinnett NC65D Trust; S. Wood, as Trustee of the Gwinnett NC55D Trust; M. Tucker, as Trustee of the HC12 GA Trust; M. Tucker, as Trustee of the HC13 GA Trust; M. Tucker, as Trustee of the HC14 GA Trust; Cecil Wade, J. Taplin; B. Taplin; and Alan Cook, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.
