NOTICE OF SALE UNDER POWER
Under and by virtue of the power of sale contained in a Security Deed from FRANKIE A. OWENS and BENNIE L. OWENS to FIRST CLAYTON BANK & TRUST COMPANY N/K/A UNITED COMMUNITY BANK, dated March 10, 2000, recorded March 16, 2000, in Deed Book O-19, Page 429, Rabun County, Georgia records, said Security Deed being given to secure a Note from FRANKIE A. OWENS and BENNIE L. OWENS of even date in the original principal amount of Forty Two Thousand Seven Hundred Fifty One and 79/100 ($42,751.79) Dollars, with interest from date at a rate per cent per annum on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Rabun County, Georgia, within the legal hours of sale on the first Tuesday in May, 2016, the following described property:
All that tract or parcel of land lying and being in Land Lot 83 of the Third Land District of Rabun County, Georgia as depicted on a plat of survey dated October 7, 1998, prepared by Eddie B. Davidson, Georgia Registered Land Surveyor No. 2586 and being designated as Tract B containing 0.987 acres. Said plat is of record in Plat Book 41, page 89 in the Office of the Clerk of Rabun Superior Court and the record thereof is herein incorporated for the express purpose of establishing the description of the real property being hereby conveyed.
Reference is hereby had and made to a Road Right of Way Easement of even date herewith. Said Road Right of Way Easement is of record in Deed Book F-18, Page 462, aforesaid records. As depicted on the above reference plat, there is a ten (10) foot wide gravel drive extending in a Northeasterly thence Easterly direction from the above tract of land to Colonel Lane (see above referenced easement). Said Colonel Land extends in a northerly direction to Luther Owens Road, a public road. Also conveyed is a perpetual, non exclusive road right of way easement over and across the above described roads for the purpose of providing road access to the above described tract of land with the public road system of Rabun County, Georgia. The above described tract or parcel of land is hereby conveyed subject to the rights of others to use said roads.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is FRANKIE A. OWENS and BENNIE L. OWENS or a tenant or tenants. FIRST CLAYTON BANK & TRUST COMPANY N/K/A UNITED COMMUNITY BANK, as attorney in Fact for FRANKIE A. OWENS and BENNIE L. OWENS.
