Under and by virtue of the Power of Sale contained in that certain Security Deed given by Thomas Scott Brodeur to Mortgage Investors Corporation, dated January 29, 2011 and filed February 8, 2011, recorded in Deed Book 01663, Page 00065, Liberty County, Georgia Records, later Assigned to Green Planet Servicing, LLC now known as Planet Home Lending, LLC, conveying the after-described property to secure an Adjustable Rate Note in the original principal amount of Ninety Thousand Seven Hundred Twenty Two Dollars and No Cents ($90,722.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Liberty County, Georgia, within the legal hours of sale on Tuesday May 3, 2016, the following described property: All that certain tract or parcel of land situate, lying and being in the 1458th G.M. Subject however, to those certain restrictive covenants contained in that certain warranty deed from Mary L. Caines to Leroy Fairman, dated April 5, 1969, recorded in deed book 115, pages 208-209 in the office of the Clerk of Superior Court of Liberty County, Georgia. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Adjustable Rate Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
