STATE OF GEORGIA COUNTY OF GLYNN NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Security Deed and Security Agreement from TUTCO, LLC to BRANCH BANKING AND TRUST COMPANY, dated September 1, 2011, recorded September 2, 2011, in Deed Book 2900, Page 315, Glynn County, Georgia records; also that certain Assignment of Leases and Rents dated September 1, 2011, recorded September 2, 2011 in Deed Book 2900, Page 323, Glynn County, Georgia records, said Security Deed being given to secure the payment of an indebtedness owed by TUTCO, LLC to Branch Banking and Trust Company, together with interest thereon on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Glynn County, Georgia, within the legal hours of sale on the first Tuesday in May, 2016, the following described property: PARCEL 1: All of that certain lot, tract or parcel of land situate, lying and being in G.M.D. 26, Glynn county, Georgia, as described on that certain plat of survey prepared by Shupe Surveying Company, P.C., Gary R. Nevill, Georgia Registered Land Surveyor No. 2401, entitled "Survey for Brunswick-Glynn County Development Authority, 0.479 acres adjacent to Indigo Drive, Brunswick-McBride Industrial Park", dated April 16, 2007, a copy of which is attached to that certain warranty deed from Brunswick and Glynn County Development Authority to Tutco, LLC, dated June 8, 2007and recorded in Deed Book 2244, Page 274, in the Office of the Clerk of Superior Court of Glynn County, Georgia, as all of said 0.479 acre tract. Reference is hereby made to said plat for the purpose of describing the metes and bounds of the subject property and for all other purposes. PARCEL 2: All that plot or parcel of land situate, lying and being in the Glynco Industrial Park, Glynn County, Georgia, and being more particularly described according to a plat of same by Joe Biletzskov, Registered Land Surveyor Number 1672, dated May 12, 1978, as follows: To find the Point of Beginning, begin at the intersection of the center line of Etheridge Drive (a 120 foot right-of-way) with the center line of Sidney Lanier Drive (a 100 foot right-of-way) and run thence North 65 degrees 08 minutes 59 seconds East along the center line of Sidney Lanier Drive a distance of 3,182.15 feet to a point marked by a nail and cap; thence North 24 degrees 51 minutes 01 seconds West a distance of 50 feet to an iron pin on the northerly right-of-way line of said Sidney Lanier Drive, which is the Point of Beginning. From said Point of Beginning run thence North 24 degrees 51 minutes 01 seconds West 290.40 feet to an iron pin; thence North 65 degrees 08 minutes 59 seconds East 300 feet to an iron pin; thence South 24 degrees 51 minutes 01 seconds East 290.40 feet to an iron pin on the northerly right-of-way line of Sidney Lanier Drive; thence South 65 degrees 08 minutes 59 seconds West along said northerly line of Sidney Lanier Drive 300 feet to the Point of Beginning. The aforesaid plat by Joe Biletzskov is hereby incorporated by reference for all purposes. Being the same property conveyed by that certain warranty deed dated December 29, 2004, from DMK & R Corporation to Tutco, LLC recorded in Deed Book 1577, Page 288, in the office of the Clerk of Superior Court of Glynn County, Georgia. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is TUTCO, LLC or a tenant or tenants.
